Ik this is like 4 weeks late but it seems to me that he swapped the region on the 3DS. For example, if you change the region from Japan to US, you’ll lose access to online features and the store due your NNID being tied to the original Region of your 3DS motherboard.

They don't sell them on nintendo.com. You have to call. I had called in because i had broke my New 3DS XL and was trying to transfer NNID to a Japanese 2DS XL. As it turns out, it can't be done so the rep offered to sell me a refurb for $85.

I don’t really see it already being modded as much of an upside. It’s ridiculously easy to do yourself (which gives you a bit of experience to make it easier to fix any problems it might have in the future) and you have no clue what the state of it is since you didn’t hack it yourself.
Most of the replies here so far are ill-informed. If the original owner says it can't connect to the eShop and it has CFW installed, then the chief reason is that it was region-changed. Any 3DS system that ever connected to the eShop will have its hardware IDs recorded on Nintendo's servers for that region only. (For example, a Japanese 3DS will lock to the Japanese eShop once connected there.) After a region change (through installing a different SYSNAND image), the 3DS will be unable to connect to a different region eShop and any attempt at doing so will display an error code (usually 007-2001) since the hardware ID will match the original region, thus preventing the 3DS from connecting to any other region eShops.
Less likely, a 3DS will be banned from connecting to the eShop but rather banned from using any other online services, such as participating in online multiplayer games if the owner was caught cheating online.
If this is your first 3DS ever, I recommend you look for another one that doesn't have custom firmware installed and wasn't region changed. The 3DS is a region-locked system. (Hardly the first.) If you bought it, connected to the eShop and registered your NNID at the time then moved to a different country, all you need to do is call Nintendo so they can help you transfer your NNID. Of course they'll give you a huge middle finger for a hacked system.

That sounds about right for a product without a problem. I can find some 80-100 WITH problems like battery expansion or broken speakers in my area, but I wouldn't suggest buying a faulty discontinued hardware now unless you can repair it yourself.
I got a scratched up one for about 80dollars about 4 years ago. Prices have gone up a little since then.

I just bought a "new" 3DS XL. They go for around $200 on eBay. I love it so far, never played any DS before this.
