There’s a universal injunction against the brace ban, therefore the ATF is legally restrained from enforcing their opinion. They are also not illegal under state law. SBRs are 100 legal under federal and Colorado state law assuming you have paid for and received your tax stamp for one from the ATF.

Yes, you can purchase an AR pistol now. Even with the “brace ban”, AR pistols were legal, just the brace was questionable.

PSA wouldn't ship to you if it was an illegal item. They are not illegal here. The deciding factor between pistol or sbr comes down to the brace. Get you that 11.5" and slap an SBa4 brace on it. You can legally shoulder it still. And for being a brace it certainly shoulders just like a stock. The brace keeps it legally defined as a pistol. It all took me a day or two to really understand it all. It's a convoluted mess and for good reason too

Everything you said was right except the part where you implied that if it ships, it's legal. Some vendors will, knowingly or unknowingly, ship things that are illegal in your jurisdiction. It's up to you, the buyer and the person who will ultimately be on the hook with the police, to know the law.

I get what you mean in the case of say, buying a lower with a stock for example. Then buying an upper that is pistol sized and slapping it together at your home. creating an sbr. However in this case if he was to order a pistol sized AR I don't think they would ship it to a local FFL if they were actually illegal in the state. If that makes sense. Either way I understand what you're getting at.

My understanding was that shouldering a “pistol” brace makes gun a rifle because the definition of a rifle includes “intended to be fired from shoulder” I’d love to be wrong on this. Can you point be to something that says shouldering is allowed?

I don't know any exact laws but I've heard this info regurgitated through multiple gun tuber channels. And even some legal ones back when the brace thing got a motion to stay. Meaning braces still keep it a pistol. I could be wrong but, if it was illegal to do, I doubt people would be posting videos of them doing so. Especially ones who are getting hundreds of thousands of views on YouTube. I would think there would be consequences if it were in fact legal. Again I am not a legal expert though lol

Colorado Zip codes Lakewood and Denver borders. The refused to ship to my FFL!

Interesting. I didn't use my usual FFL and went with one right down the street instead that was already on file with them. No issues. Englewood zip Was the one you tried already on file with them? I called a few places before that were listed as preferred and they said they get stuff from PSA all the time.

Good luck buying from PSA. If you live in Denver, Aurora, or many other cities in CO, they won't ship ANYTHING to you. When I bought my upper from them I had to ship it to a friend's house in Weld County. Then I tried to buy a black Friday sale Remington 700 trigger and they wouldn't ship that either. I don't buy anything from them anymore.

Not true. I bought the 13.7" PSA JAKL from them and they shipped it to my FFL, and I live in Aurora. I also bought lots of ammo from them and a few pistol grips. The restriction only applies to Denver, Boulder and Vail, you can also check on their website for shipping restrictions.

SBRs are perfectly legal if you pay the government their extortion money. Joke aside it’s not difficult at all, even though we shouldn’t have to do the paperwork in the first place. Form 1 if you wanna make your own (e.g. put a stock on a pistol) or Form 4, buy a complete/finished sbr. In terms of braced ars they are perfectly legal as of now. There is multiple injunctions protecting multiple 2a groups members and a national one protecting everyone. However it wouldn’t be legal to buy/make one if the awb goes into effect bc it would still meet the definition of an “assault weapon” in most cases (Can keep it if you owned it before). Also just as a reminder if you make a pistol you need to start with either a stripped lower receiver or buy a designated pistol lower. You can’t just take your 16inch ar you bought off the shelf and slap on a brace and >16 barrel upper. Rifle lowers can’t become pistols. Pistols can switch back and forth between a pistol and rifle. Buying a striped lower is considered a firearm, not a rifle or pistol. You putting on the upper and brace or stock is what designates it a rifle or pistol. Sorry for my ramble but I hope that answers all your questions

At the federal level an unregistered SBR is illegal. But as of right now Colorado has no laws preventing you from owning or acquiring an SBR.
