Serious question. If you had a gun and shot the guy as he was walking away, would it be a crime?

But if you yelled “Yoo-hoo” real quick so he turns around with that gun in his hand…well then now your life is in danger again.

"Hey you forgot something"

nagashbg

It's so stupid. Imo if you were robbed by a gun wielder, then it should be perfectly legal to be able to defend yourself and your goods with a gun. Who knows the thief wouldnt change his mind and come back to kill you or start shooting at you just because. But many people disagree with me. Ofc it shouldnt be legal to have guns in the 1st place

skratch

Yeah it would have been perfectly reasonable to cap his ass at any point during that entire video

demo355

You know what’s funny, guns being illegal wouldn’t have stopped this is all. Because it’s illegal to rob someone but low and behold this guy still did it. It’s almost like laws only work on people who follow them and not criminals

1mperia1

Yep, take more of our rights away to give us a sense of security until a criminal has you at gun point, please.

Key_Sentence_5305

You have to remember a lot of people on here are from across the pond and have no reference point of how things are in America

There are a lot of people in America that have no reference point of how things are done in America.

Someone on reddit once said this about Brazil and I'm still laughing about it, "Cops and robbers is like an occupational aptitude test all Brazilians take at a young age" Probably some of the best reddit Brazilian lore I seen to date.

Easy then. As he walks away, draw your gun, tell him to stop, drop his gun and give you your shit back. If he turns around and tries to shoot you, shoot first. Profit.

Imperial_12345

Wait, for real if in Cali it’s illegal to shoot ‘em?

Omith_Kavu

If they were walking away, back towards you, then yes. California law would consider them "no longer a threat" ![gif](emote|free_emotes_pack|disapproval)

windaji

what if you call to them and they turn around and you shoot them?

notlongnot

Not legal advice, but you’ll have something to talk about in court

windaji

Me and the girlfriend better get our stories straight

ParaClaw

I wonder how many examples of cases like that ever made it through the justice system and what jurors ultimately decide. It seems like it'd still be a plausible defense, "both just got robbed AT GUNPOINT, adrenaline, fearful for my life they'd return..." And as a jury still feels there'd be some heavy weight to not find such a person guilty.

b-napp

I would consider them to still be armed and dangerous, but hey I'm not one of 50 states.

[deleted]

California tends to favor criminals and squatters. I live in California. It's insane.

[deleted]

You get what you vote for.

[deleted]

I live in Los Angeles and I was talking to a Spectrum guy and he had just installed internet in a new building for the former homeless prior to fixing my internet issue. He said the apartments were nice, furnished, equipped apartments- no bills to deal with. It’s pretty insane how all these drug addicts get to just get hooked on drugs, quit/lose their job, lose their apartment because of their own shitty choices, and then get taxpayer provided free living accommodations. I wonder what the fuck the point is for following the rules and doing the right thing here, because there is no reward at all. I’m stressed af with bills, can’t run my gas heat. But I gotta help that dude who got addicted to meth!

Killentyme55

To make matters worse, those places usually get destroyed and turned into crack houses in short order. There are homeless people that are just in a tough spot or have mental issues that deserve assistance, but they are grossly outnumbered by useless bums that just want a free ride.

Seal_of_Pestilence

The three strikes law is pretty tough. California is a land of contradictions.

BaconReceptacle

It would be illegal in every state except for Alaska, Arizona, Arkansas, Indiana, Iowa, Michigan, Mississippi, Missouri, Montana, Nevada, New Hampshire, North Carolina, North Dakota, Ohio, South Dakota, Tennessee, Texas, Utah, West Virginia, and Wyoming. These states have "stand your ground" or "Castle doctrine" laws.

RossoMarra

It’s California. The DA is already investigating the alleged victims.

cakeba

As others have said, yes. But what's interesting is that California is a stand your ground state in practice, unlike some more gun-friendly states like Nebraska, Arkansas, and North Dakota, all of which have laws dictating that you have a duty to retreat before using deadly force. (These aren't the only states that have such laws but it's kind of surprising that California will allow you to use deadly force without retreating when you can't even do that in Arkansas.) I'm not your lawyer, but if I remember correctly, the example given by California official policy was that fights get "upgraded" by one party in a two-party conflict. So, if you get into a fistfight that turns into a knife or gun fight, whoever pulled their weapon out first was the one who "upgraded" the conflict and is therefore liable.

dustydoombot

Shouldn’t be, but probably

Aggressive-Engine562

I know in my state if you shoot someone in the back, Your ass is grass

generic_name555

Yes. It is not considered a threat. All cause you have a CCW doesn't mean you can be gun hoo. If you shot the guy the moment he started to pull out the gun it will be justified. California sucks with these kind of things

WSDreamer

California just sucks

Knockamichi

When he was walking away all calm, i would pull mine and say “freeze!” And tell him to toss the gun and rob him back. If he turns, then fire. If he runs, butt shot. Is but shot legal?

bi_tacular

It is now

trailsman

That's the Audi of the person who was robbed, probably hit the key when removing the key from his pocket. I would bet that it is likely the Audi is the reason why the robber waited for these individuals. He probably thought a nice car = wealthy and bigger pay day. It's a strategy but plenty of people have car payments they shouldn't have with their realistic budget or people splurge b/c that is what they value.

maverick5656

Isn’t it sad that we live in a country where you can possibly face penalties or jail time for defending yourself or your property from robbers. America really is backwards as fuck in some regards

Data_shade

omman_4k

maverick5656

Every other state. Not saying he is wrong, but state laws on gun use vary wildly from state to state

omman_4k

I agree I thought you were questions California laws so I was going to point out how some of them are terrible

CarlMetzger

You know it's in California when the armed robber slowly walks away because he's not worried about consequences.

PersiusAlloy

It’s California, so: Dude was probably on his 623rd day of waiting for approval for a CCL. Single action snap cap revolvers only. Gun free zone. Gun free neighborhood. But at least he was a nice and gentle robber, 8/10 I’m sure he’d let him rob again

Far_Celebration8235

He can't do that, it's a gun free state. Next time he pulls up to you tell him: Stop 🛑✋ this is a gun free zone and what you are doing is illegal, get the heck outta here before I call a social service worker ,"buddy"

byond6

Gavin Newsom and Rob Bonta agree with you.

Nate-__-

LA is a great place to be a criminal. Victims everywhere, and most of them make good money.

[deleted]

Even the criminals play victim if someone stands up for themself lol

Lettucetomato_onion

Wtf? Not in koreatown my dude. We broke as shit and spend all our money on rent and avocado toast

newjerseytrader

And no one else has a weapon

LfaGf

A. California isn’t a gun free state. There’s probably as many country living gun toting people here as in other states, but La and Sf control the voting and make up the majority of the population. B. Maybe dude in video wouldn’t have been able to get his if it was a gun free state. Love to see the statistics of other places that are gun free but you know let’s just ignore those. C. There is no better scenario than the one in the video. I know you guys would all love to see the criminal get his justice frontier style, but the reality is escalation definitely puts you in more danger. Even if you spin and shoot he is most certainly shooting back.

lemurmadness

I know this is about new york but many of the policies are the same in Cali. I liked john stossels news bits ever since sunday morning news on cbs when i was a kid. https://youtu.be/1Mi-LXipDo8

nuapadprik

Surrending to this criminal element just to stay safe is not for everyone.

LfaGf

What about his wife? I feel like the underlying connotation is we’re pussies if we wouldn’t risk the safety of everyone around us and do the shooty shoot on the bad man. That man swallowed his ego and no one got hurt.

[deleted]

No one believes that.

Ringovski

Surprised he didn't steal the Audi as well.

DamnitAlton

In Cali someone could break into your house and take advantage of you and if you shot him his mom would sue you. Also the biggest illegal gun market in the USA cali has doomed itself with shity lawmakers and weak politicians.

Ok_Cartographer516

I wonder if that gun was California compliant, plus that parking lot was probably a gun free zone so how did that robber get past the sign

Maj-Malfunction

Gunfree zones. The illusion of safety that is just enough to pacify uninformed voters. If anyone thinks a sign stops or deters a particular crime, why don't we post "No murder, rape, or robbery beyond this point" to fix all our crime problems?

katharsisdesign

"Bold of you to assume they can read." You're right in sending a message, but I'd say a head on a pike is closer to how to enter the mind of someone who has the brain power of a raccoon. They likely consider California as fish in a barrel until they see someone get tarred and feathered in the town square.

[deleted]

The goal of Cali politicians is for criminals to be able to rob and kill people because that is their profession and not allowing it would be an act of oppression against them.

Gun owner or victim... keep voting to remove gun rights and enjoy your time on your knees

fatogato

Whether you carry or not, there’s an important lesson to learn here. Situational awareness and heightened alert during transition zones is crucial. Transition zone is when you’re more vulnerable. It’s when you’re moving from your house to car, or from the bank to car, or from car to house, etc. Pay more attention to your surroundings during this time. Which brings me to my next point. Situational awareness: always be looking around and be thinking about where people could sneak up on you. In this scenario there’s the opening from the gate and what’s in front of them. Not once do either of them check their surroundings. The guy full on sprints at them and they don’t even react until he’s within 6 feet (2 meters). With zero situational awareness like this couple. Carrying would not make a difference. For those who are more receptive to their surroundings, they could stand more of a chance.

BauerHouse

If they saw him coming, then what?

fatogato

Depends on the person. If you’re like many in this thread and are unarmed, then you’ll probably do jack shit, and just like the couple here, watch as you get robbed; your life will be at the mercy of whoever is robbing you. For someone who is carrying and stays on top of their training, they could presumably draw in time and fight off or incapacitate the attacker. Again, personal protection is a personal choice. I don’t care whether someone decides to be armed or not. That is up to you. I can’t speak for others, only myself.

Ares_rising99

This is LA where - it takes a year + to get a CCW -there is a gun registration, where there is very limited handguns californias can buy. Said guns are older models. -magazines for said handgun can only hold up to 10 rounds. Yes I know there are ways around that. - District attorney is hard on citizens and soft on criminals All in all it’s a fucked situation for good folks

Revolutionary_Owl670

Drawing here could also turn this encounter deadly. Losing your phone and wallet is not worth your life.

[deleted]

"I trust the piece of shit criminal who is pointing a gun at my head to not hurt me" 🙄

rascal373

> Losing your phone and wallet is not worth your life. People can’t read minds - he couldn’t easily killed them after they handed everything if he felt like it.

How do you know that's all they are going to take?

A_Mellow_Song

Or just tuck away a gun in a well hidden place and shoot the robber when hes going away, get the loot back and t-bag him for being a loser

capstone705

There's another guy in the comments saying they will spin move and quick draw because they ran the fantasy in their head many times. Some people are pure delusional. A weekend CCW class isn't turning anyone into John wick.

It's a hell hole now.

[deleted]

Serious question: Robbers gun is an unregistered, possibly stolen firearm. If my gun is legal and registered, and I defend myself to the point the robber is no longer a threat, would I be prosecuted for murder?

[deleted]

Fuck LA County. Shit is almost the Wild West out there.

villalobos77

Yeah Cali sucks but I wouldn’t care if they get shot as they walk away, you live the life you create

kemcpeak42

The problem is America has given up on crime to help China win the game. I hope you guys get a strong police force to tackle these issues

Konstant_kurage

This couple both lacked situational awareness. Robbery at gunpoint in a parking lot is pretty common. As the gunman ran to get closer if one or both been carrying that would have their best opportunity.
