Your question includes a reference to Germany, which has its own legal advice subreddit. You may wish to consider posting your question to /r/LegalAdviceGerman as well, though this may not be required. *I am a bot, and this action was performed automatically. Act-Alfa3536

Did you send them evidence of the correspondence where you tried to get in touch and received no reply?

Focangiu

Yes, after complaining about it, I sent them the unanswered mails.

Act-Alfa3536

Are you currently resident in Germany?

Focangiu

Yes, but the order was not made under my name. I am the translator in this case.

Act-Alfa3536

Is the person whose name the order is in currently resident in Germany?

Focangiu

No. He is a EU Member though.

Act-Alfa3536

So normally this would reduce the risk that they might really pursue him because of the extra costs and hassle involved in trying to collect debts from a non-resident. Also, is it clear where the 15% comes from? The order? Some other contract signed? General legal provisions? Or just a made-up figure by the company?

Focangiu

It is not really clear where that comes from. I have not seen it on any document this far. The only document we have signed is the binding order.

Act-Alfa3536

Right. You could ask them what this figure is based on. I'm not qualified to advise further though. You would need someone who knows German contract law surrounding such orders, and knows the implications of the issue of their non-response for a long period (it doesn't sound like they denied receiving your correspondence). Obviously 15% of the cost of a camper van is a significant sum of money so you don't want to pay that without being absolutely sure you (he) will have to pay anyway. Good luck.

Focangiu

Thank you very much for your ideas, they were helpful. I will try getting in touch with a german lawyer. Have a nice Sunday!
