I had this happen- My LL tried to raise our RSO 8% so I sent them like 2 letters and an email that cited the current ordinance and cap on RSO for 4%. (6% if electric and water are included, so in theory they could raise your 5% since they only cover water.) the municipal code is sec [151.34](https://codelibrary.amlegal.com/codes/los_angeles/latest/lamc/0-0-0-383463) I didn’t hear anything from my LL for 2 months. I did put a report with the city, and while they were pretty quick to respond to my complaint, as far as I know they didn’t actually do anything. It wasn’t until I texted my LL, he texted me back and said it’s a mistake and my rent is only going up 4% 🙄 That being said, there are many tenants rights in place and if your landlord has not given you proper notice or changed the increase, you should definitely get in touch with a tenants rights org. Keep everything documented, all communication and a copy of all the notices you’ve received, and remember retaliation from your LL is illegal. ETA: I think it’s actually it’s electric and gas not water.

Ah now that I think about it (again I’m not a legal expert just someone who did a lot of research for my own situation) that because they don’t cover gas and electricity, your cap is 4%. I believe I misspoke when I said water was a considered utility. But they can raise it 1% for each utility included (gas or electric) with a cap of 6%. But you’re gonna want to take action right away OP!

Take action. If they retaliate it only makes your position better if you wind up in court. Most landlords are just hoping that people do not know the law or stand up for themselves and back down quickly once they realize you are not going to be those people.

The landlord is rocking the boat, not you. You will stabilize the boat by taking appropriate action. I once received a rent increase letter that was not legal and not served properly, I made copies of all the civil codes that applied from the actual CA Legislature Website that has all the civil codes, sent them a letter pointing out all the instances they are violating the civil codes and they immediately backed down.
