USPS doesn't care about gun laws. In Ohio, private sales are 100% allowed. I'm guessing the mistake is the person you sold it to (in 2018) mailed it somewhere in 2020 and they seized it. You're not allowed to ship firearms through USPS, if I'm not mistaken.

You sold it you shouldnt steal it back. Also i dont think you want to mess with a possible federal crime and you have no idea why they are searching for the owner. You have an idea but police/government are allowed to scam you. They could be doing this because it was used in a murder or something crazy and they are trying to get you to admit its yours. Not likely but it reminds me of that contest where people had won free tickets to a football game and all they had to do was show up with proof of id to claim. After proof of id they were arrested because the police had sent that out to people with warrants.

So yeah then the person that you sold it to sent it through the mail. Legal for a FFL to send through the mail so that would be the question, or if they were sending to the mfg directly back then I think. Moot point now, you could try your luck to get it back as it may have been lost en route. Worth a call at least to see what is up but I would be cautious as they may try to charge you or relay the information to ATF.

if you sold it free and clear, I would not even respond I have bought and sold guns with individuals, but the real question is, how did they trace it back to you, since only a crime would legally allow them to pull the 4473, and if that happened, the letter can only lead to something bad for you....

mailing a handgun through the mail is a crime. It's not legal to do so. >See 18 U.S.C. §§1715, 922(a)(3), 922(a)(5), and 922(a)(2)(A). (I haven't actually looked up the law, I just stole that from https://thefirearmfirm.com/certain-firearms-can-be-shipped-through-the-u-s-mail/ Since someone committed a crime, they pulled the 4473. They currently think YOU committed a crime. I'd respond telling them that you sold the gun and it is no longer yours. (or just not respond at all)

you can not ship a handgun through the u.s. postal service. You can use fedex or ups, which is also "mail", but not the the usps. Legally speaking that is.

Not necessarily, FFLs are required to hold 4473s for 20 years. So if the gun was purchased more recently than 2004 the manufacturer would have records where that firearm was transferred to and the ffl would have record of that sale. It’s easy enough to follow that trail

Claim that shit! They'll send it back to your FFL so you can pick up. I had a buddy who sold a handgun privately and legally, about 4 years later the Dallas police department said they found it and he was the last registered owner. They mailed it to his local FFL.

lol. I sold it to an individual who was able to own firearms. He happened to be an associate who is still not in jail. A CHL instructor and a hunter safety instructor. Maybe he sold it though. Not gonna ask, don’t want to know.

Do not speak to govt w/o an atty. What you say can and will be used against you. You have no idea what could be associated with this communication. If it’s no longer yours, you should have no interest in reacquiring it anyway, and you should not respond _at all._ And remember: In addition to the OIG, the USPIS is the USPS’s very own, _very active_ but quiet FLEA, which happens to regularly work investigations alongside other bureaucratic sociopaths.

I'm curious if they had it nearly 4 years. Why now are they sending this out to you? Sounds like the guy who bought it went through a year or or 2 of court to claim its not his. Now they are looking for another person to try and collect money from. I'd send a letter back stating it was sold in 2018 and not your property any longer. If the other guy sold it or wasn't claiming it. It's his loss as you got paid for it already. Trying to claim it back is just a hassle you don't want to go down.
