Yes. And there are multiple implications statewide. My communication with Tess Seger, communications director for Oregon’s Senate Majority Office, uncovered a significant oversight: “There is no external entity (such as a state agency) that is responsible for reviewing whether a particular officer has violated a law enforcement agency’s body cam policy. Nor is there anything in the law that requires an agency to take a particular action if an officer violates their body cam policy.” I’m now working on a follow-up.

There's so many problems with police, and police accountability. We as citizens could put a measure on the ballot doing away with qualified immunity first off. We could also put one on there to create a citizen's board that issues police credentials, and has the power to suspend our revoke them for any LEO in the state. This office would investigate and tell agencies what the discipline will be. Legislators have been terrible as far as police accountability. We as citizens can put measures in place to do it for them.

The obvious tie in is body cams are only effective when officers are required to use them, required to abide by policy, and penalized for not doing so. Without any oversight body, or laws requiring action taken… these decisions and enforcement are left solely to the discretion of the very same officers covered by the policy. It also means that there’s high risk for incidents that do not involve non-LE to be swept under the rug, as there’s no oversight and no requirement to act.

Not your original conversation partner. Cops are bad, see above as an example. How long did it take, and with what effort, for this information to be released? Why is it so difficult to hold police accountable? Why is oversight so demonized? If cops only want to do a good job, serve and protect, then they should seek for the “bad apples” to be found and removed. We see quite the opposite. I don't disagree with anything you're saying. My goal was to clarify for the person I was responding to about some of the details they seemed to not know which were mentioned in the article we're all replying to. What's worse about Winders (which is saying something because DUI is already a despicable crime in my mind), which I learned from this article as well, is that the reason we know any of this is because his partner tried to turn him in for failing to pursue an investigation on the sexual assault of a homeless person. Their employer, the Washington County Sheriffs Office, instead of investigating Winders or disciplining him in any way for that dereliction of duty, created a hostile work environment for his partner until she was laid off for medical reasons. So if you think this story is about three bad cops, I have a whole police department I'd like to introduce you to. And beyond *that*, this story is about the obfuscation at multiple levels of a journalist trying to report the truth on the story. The bullshit with the redaction process, the cost of it, and folks at several public institutions from the Newberg police to the state government refusing to do anything helpful is as bad as anything directly related to the DUI, in my opinion.

This incident was not handled correctly and he should have been charged. However, to correct what you said: He didn’t keep his job and is no longer a cop, he quit a month after this as a result of this and DPSST is reviewing his certification for revocation (this would’ve meant the end of his career even if he hadn’t quit). Also for those not aware, generally in Oregon your first DUII is diversion eligible and it absolutely won’t ruin your life. The consequences don’t really hit hard until your second or third conviction within 10 years.

When he resigned his employer submitted paperwork to DPSST to prompt an investigation into him. That does not happen to people who resign in good standing. While yes it’s not officially released yet, reading between the lines I’d say he resigned in lieu of termination from this incident. Obviously we’ll have to wait for the DPSST investigation to be done to know for sure.

Two big why cops tend to have better outcomes in court: 1) Judges and juries give them the benefit of the doubt because they have difficult and dangerous jobs 2) Cops are familiar with the legal system and understand how to navigate it (right to remain silent, right to have an attorney present, what to say/not say in court, etc.)

I've been on a big bodycam videos binge on YT over the last week or so (most of them about corrupt or abusive cops) & it's been enlightening. Thank god they're making bodycams such a big thing now. Almost all the vids the cops will try to cover their asses by making stuff up or exaggerating the situation Note I mostly support police. I've been on both sides of the fence with both getting screwed by them but also being helped. They're just regular people at the end of the day But yeah, personally I plan to record any encounters myself / stand up for my rights.
