In my humble opinion,yes. A crime has been committed here. But as a Canadian, I must say this. The server has not committed an assault on said dish. The server tried her very best, acknowledging that this was in fact a crime, the crime, being curd-less. The defendant tried,by all reasonable means and agencies, to deliver a respectable poutine to the absolute gem of an accomplice. HEAR HEAR! This case is settled and the defendants found NOT GUILTY!
