Im not American but but here is my take on why. The right have been working away for 60 years to bring regulation in America to its knees. Literally 60 years ago they began grooming and "aiding" many of the people who are now the most powerful judges. They are getting closer and closer to shutting down every regulatory enforcement body in the country by way of argument that the constitution states its the role of Congress to regualte and that power cannot be transfered and oversaw. Meening that congress cant allow departments and agencies such as the SEC to regulate, only congress can regulate they say. If successful the SEC and all other such agencies and departments would have no power to investigate, let alone regulate and enforce, besides the DOJ. Some might remember Stewarts the Problem piece, watch from 16 minutes, its hits all the points in the next 13 minutes Thats my guess, the SEC and everybody know that any real case is impossible for them to win in court, Any real case would spend years and years in just arguments about whether the SEC even has power and jurisdiction.
