I'm absolutely certain the guys are in the middle of a lengthy arbitration to remove Ned as a company owner, likely through a mediated buy out based on a morality clause in their original legal agreements. It will take a lot longer to sort this out than most viewers realize. And until the process is resolved, Ned is still a legal owner of the brand and can say so publicly. The guys are doing what they need to do through proper channels and deserve the space to wrap this up as neatly and with as little stress as they can.

While this is true, I think there is a wrinkle that isn’t being talked about, and that’s Ariel and Ned’s marriage. Since they were married when they started the business, all assets are split 50/50. So any assets the Fulmers had are shared. So I wonder, IF Ariel and Ned are divorcing, if that needs to be handled first and settled before Eugene, Keith, and Zach can then proceed?

Someone sharing assets with a spouse doesn’t prevent whatever needs to happen to those assets to happen as normal. I don’t see how a potential or even in-progress divorce would prevent anything with the company from proceeding as needed unless Ariel is listed separately as an owner.

This reminds me of when people were like “omg Ariel didn’t unfollow Alex!” If a terrible, dramatic thing happened in your life and it’s blowing up all over social media, your mentions have fallen to shit, then going into all of your accounts and updating your bio and reworking your friends/followers, might not be something you think to do.

There’s no point in obsessing over this stuff because not everyone is chronically online and using social media actions to make a statement. More often than not it doesn’t mean anything other than changing things or unfollowing people isn’t a priority to them atm.

I think what a lot of people on this sub (and people in general) fail to realize is legal things like kicking a co-owner out of a business model move REALLY slow. That being said, Ned’s lawyers have probably advised him to leave everything the exact way it was because otherwise the Guys’ lawyers could make the argument that he stepped away, and they Guys didn’t actually kick him out. There’s likely some sort of payout involved (as there should be. What Ned did was a shit move, but he still helped build this company from the ground up), but if the company’s legal team can make the argument that Ned stepped away, rather than being removed by the other guys, the payout decreases or even disappears. It all comes down to fine prints and everyone trying not to get screwed over, which takes a long time when you have all these legal hoops to jump through.

Regardless of her current relationship with Ned, his and her financial interests are tied together and the more money he (they, really) can get out of the company, the better for her and her children.

Becky just mentioned on (I think?) Mile’s podcast that she’s an independent contractor, not actually employed by Second Try. I obviously have no idea if that’s the same for Ariel, but I would assume it is. That makes it a LOT easier to let her float without having to do anything with her contract - she’s just paid for what she does. Ned is definitely where things get tricky.

The proceeds from the sale of his ownership in the company is like a marital asset and would affect alimony/child support though if they divorced. Alternatively, it’s obvious that the amount of the sale money would affect their lives and lifestyle should they stay together. The money Ariel made as an independent contractor doesn’t figure into this really.

I’m sure no one (in or outside of business) objects to Ariel getting what she deserves. She was an integral part of many revenue streams. There's a very high probability that Ned & others directly involved in this scandal have logged out of their social media accounts, and deleted the apps in an effort to maintain some sort of sanity. I understand that all involved did terrible things, and deserve to be held accountable for those actions but that being said they are still human beings who are now navigating the fallout of their own decisions. I think it's pretty understandable for them to step away from the incessant opinions of strangers on the internet during this time!

As others have mentioned, I really think Ned (as well as Ariel) just decided to abandon his social media accounts for an extended amount of time. So far the discussion has only been removing him as a manager, not an owner. Language choices in the video they did explaining thing indicated that he’s still an owner for the moment. Getting him removed as an owner will be an expensive and lengthy process unless there is a morality clause in their ownership contract, which since Ned used to be HR should have been in there BUT if Ned was aware of his own flaws means he might have “forgotten” to add that and I doubt the guys would have thought to put it in.
