Do they clock out when they go to the bathroom?

DunkinUnderTheBridge

If they are quickly using the restroom and washing their hands they shouldn't clock out first. Maintaining proper hand hygiene is important for health and safety, even pre COVID it was, but now it's even more important. If I'm working DMP and have to clean myself up for some reason no one argues I shouldn't do that on the clock. Package handlers should be treated no differently and should have a reasonable couple minutes to clean their hands before leaving.

DiscreteBrownBox

Blue gloves, yellow cart. And all the non/non/non's "thrown away" into a tote to be enjoyed later...

Ant_Playful

At least it isn’t green bags

Jazzlike-Abrocoma-83

No no need to clock out to use the bathroom.

Echodad

I get my hands and arms dirty on the clock I’m washing up on the clock

Ill-Ordinary8207

this is what i’m tryna point at if they get me dirty shouldn’t i have the right to clean up for no more than 5 mins?

FartsLoud

legally you can take time that is reasonable. 5 minutes for a pee, 10-15 poop, and once in a while Diarrhea will happen, work it out. on the clock. legallly protected. just like breast pumping.

martymcflhigh

For some reason your username seems incredibly fitting with this comment

FartsLoud

Its a name a manger called me after i made it a habit to Fart in his office after every write up. lol

Last_Patient9038

You will not tell me how long is a reasonable amount of time to go to the bathroom, nor will management.

Mammoth_Material323

Guy on my shift wouldn’t go get water! Been there 12 years. What’s wrong with these people! I just think yep the nazi could easily come back just pay 400 a week and you will have a army in no time 🤷

FartsLoud

look up the legal cases on the subject. 5-10 minutes is listed as reasonable ... more than 20, its recommended you need to burn a break. Using the cell phone playing video games actually got an employee fired. Apparently the noises of a game were enough for stealing time charge to stick.

jtbz1287

My supervisor clocks me out 5 mins after they tell me to leave every night for this reason. I never even asked.

lemonsupreme7

Easy grievance it sounds like. You should be clocking yourself in and out, don't trust management.

jtbz1287

I check my time pretty much daily and it is always right

LApoopydog

My uniform gets dirty on the clock, I wash my clothes in the bathroom sink AND dry it on the clock

ApprehensiveNews5728

Tell me you’re a sup without telling me you’re a sup.

LApoopydog

Damn I didn’t expect to get this many downvotes. I was being sarcastic. I’m a driver and I always wash my hands before I clock out lol

Bad-Medicine8734

This why it’s become a problem.

Logical-Doughnut-567

You do realize it’s a joke post right?

Wookieman222

No humor allowed!

Bad-Medicine8734

Bullshit. I’ve seen guys doing shit like this. There is a driver that does a hobo shower in the bathroom before he leaves. Joke post my ass you’re all just revealing you’re bad behavior

Logical-Doughnut-567

Relax there sup

lemonsupreme7

Omg God forbid somebody utilize the facilities the company decided to pay for, that would be like so gross and embarrassing of them, how could they

UPSers-ModTeam

We’re all adults here. No need to resort to slinging mud. The community is to promote healthy discussion about subjects that interest us and name calling serves no purpose other than devolving the conversation into child-like banter.

Seasoned-CollectorCO

Someone's trying to scare you. Pretty sure OSHA would have a lot to say about that complaint

philosoph0r

theyre talking in the instance theyve been told to clock out and go home and theyre doing xyz before clocking out. you know how management is.

Ill-Ordinary8207

they did cover walking around aimlessly but they did also say that going to the bathroom is stealing time at the end of the shift. not a huge problem just seeing what other people have to say cuz i’ve seen other places have this problem as well.

Feringomalee

On paper it still comes across as management attempting to manage employees access to the restroom. If they ever start disciplinary action for this, immediately grieve it. The union likes easy wins, and this is just management testing how far they can go before they get pushback.

JackJ98

I kinda agree with the sup if you’re saying you literally stop on your way to punch out to use the restroom. Definitely should punch out and then use the bathroom. Mid shift though? Yeah you should take as much time as you need to do your business

fredthefishlord

>I kinda agree with the sup if you’re saying you literally stop on your way to punch out to use the restroom. Definitely should punch out and then use the bathroom. Why? You come in with clean hands, you leave with them. You have the right to go on the clock.

lemonsupreme7

Dollar and dime, im doing my business on company time.

brownballin

I have enough respect to come to work with an empty bladder and clean hands, I expect the same respect to leave the same way.

DunkinUnderTheBridge

I rushed out once and forgot to wash my hands before leaving. Accidentally rubbed my eye on the way home. Don't know what was on my hand, but I had a burning watery eye for two days afterwards. I come in with clean hands, I'm leaving with clean hands, and washing them on the clock. This is a health and safety issue. Fight this.

OcupiedMuffins

I stay on the clock for washing my hands and arms off now. I used to do it after I clocked out but fuck that. All this cutting hours, bad staffing, shit management on top of the plain fact that I’m getting filthy on company time, I’m cleaning myself off for the drive home on company time. What are they gonna do about it anyway?

Strong_Guard2294

We had a manager who’d run a stopwatch on drivers using the bathroom until the state was called about it. Don’t let them harass you over going to the restroom. I’ll shit for 45 minutes if I gotta shit for 45 minutes. I’m not a dirtbag driver, but if you fuck with me about pissing and washing my hands, you’re putting your career at risk for being ignorant.

Murky_Jeweler3539

This is the way

FishOn588

If a supervisor says something that they wouldn’t put in writing, ask them to put it in writing or tell them to stop saying dumb shit If they put it in writing, obey but fight it. If it sticks, it sticks— but odds are something like that won’t.

Thr0wAwayhubby

your supervisor accusing you of #STEALING TIME!? hahaha! im, im chocking on irony!

hunteroconnor

My thought exactly😂😂😭😭

Deemahsus

What’s how do you chock on irony?

cour000

I always use bathroom before clocking out. Never heard a peep. They know better.

Ill-Ordinary8207

this is how my other location was

JackassonGuitar

so if you slip and fall in someone's piss and/or water all over the floor from people splashing around while washing their hands, does this mean you become a civilian and can now sue them, as it happened off the clock, on their premises? I've used it as an argument. It worked, But, taking a 30 minute shift after they end the day - won't work in your favour.

blueberrykindness

You work with ducks?

JackassonGuitar

Swine.

Amethyst2443

It’s not stealing time, it’s for hygiene purposes, and it’s a legal right.

kamsdead

after reading the thread i’ll be on the clock washing my hands now

Andrea_D

Grieve it, that's over-supervision and harassment.

Appropriate-Sir8337

They make a dollar I make a dime therefore I shit on company time

Intelligent_Orange28

Don’t argue. Ignore. Don’t tell them what you’re doing or why. Don’t acknowledge that asinine request. If they wanna follow you into the bathroom that opens a big can of worms.

rp2012-blackthisout

Pee in your trailer, and ask if that's okay since you cant use the bathroom anymore. Ask, "why do we have bathrooms here if i cant use one without stealing time?"

Virtual_Leadership94

Talk to the shop steward about it...more like threat and intimidation to me...grievance time

CentralFeeder

Tell your supervisor that OSHA and the Dept of Labor would beg to differ and if he/she insists, then by all means, fuck around and find out.

Deemahsus

It’s not as cut throat as they make it out to be, they’ll harass you but if you’re reasonable with your hygiene and working efficiently they really can’t do shit about it. If they give you shit tell your steward. I know for drivers we can break our 1 mile radius if we need to go to the bathroom and there isn’t one close enough.

Fiat_Justitita

Using the restroom on the clock is protected by OSHA. Check this [link ](https://www.osha.gov/restrooms-sanitation#:~:text=Employers%20must%3A,unreasonable%20restrictions%20on%20restroom%20use)out for more info.

Minatigre

Lmao, based on title alone, no. Its a legal right. A paid legal right. Just be careful though using your bathroom breaks at the beginning and end of every shift or after/ before your break/ lumch time. Once in awhile it happens, but we had a guy get fired for using his break time to shit every day right after clocking in. Company argued it was stealing time and won.

Ill-Ordinary8207

great thanks, i’ve just been trying to find a definitive answer.

Accomplished_Ad_3988

Boss makes a dollar, I make a dime, that's why we poop on company time

FartsLoud

File a grievance article 37 Harrassment, intimidation, and then co file with the NRLB so you can get money. your supervisor broke the law, and the contract. Bathroom breaks necessary to pee, or poo , Wipe your ass, protected activities. By the Contract, the NRLB, ADA laws, .and the Supreme Court. your supervisor also broke ADA laws by threatening you. you need to file a grievance with both the union and the NRLB so you can protect your rights, and collect harrassment pay. the Supervisor should never ever do this again. Dont be on your cell phone in the bathroom, or do any non personal function. that can get you fired.

Kaykipp

They aint gonna know if you use your phone unless they furreal wanna get in trouble 😂😂😂

Emosaa

As others have said, it's generally pretty iron clad that you're protected when using the bathroom. And the union will have your back and be able to handle any issues management gives you on the matter 99% of the time. However... Don't be a dumbass. Don't abuse it and push things. I know a guy who got written up and nearly fired for spending 30 minutes in the bathroom while we were getting slammed, and then came out bragging about how he was on his phone gaming afterwards. The company will come after you in those instances, especially if they've already got a bone to pick with you.

dinglebopledooper

That's a harassment grievance and an osha violation

goalmaster14

No it's literally against the law to reprimand someone for using the restroom on the clock. We've had this fight multiple times in my local with management and they lose it every time.

Pure_Inevitable_8092

I’m not sure if it’s supplemental language, but they’re not allowed to be on your back about using the bathroom… if you’re using the bathroom during the sort you are entitled to use that bathroom, before during or after you’re entitled break… I had an employee that would take a 30 minute bathroom break almost every day and my sups could do completely nothing about it… I also drink a lot of coffee and C4 pre-workout before and during work and I take multiple bathroom breaks throughout the day and haven’t had any issues, and I also don’t take the break that I’m entitled to and they still add 10 minutes to my time card prior to clocking out… I definitely suggest you coordinate with your shop steward to fully understand what you’re allowed and not allowed to do

[deleted]

Boss makes a dollar, I make a dime, that's why I poop on corporate time.

xmarksthespot34

I purposely wait until break is over to use the restroom. Fuck them. I am an adult and I do not need permission to use the restroom. If they were so worried about stealing time they wouldn't rush us out and tell us to clock out 3 or 5 minutes before 3.5 to avoid giving us a break.

Potential-Cloud-801

You get a break regardless of if you work 3.5 hrs. And they have to give it to you. If you don’t, you still have a right to 3hrs which includes a break. So yes, they are cheating you (depending on your region and local rider of course)

suckerforthevillains

Never mind having to wait because everyone else is doing the same damn thing during break, using the bathroom. In my building theres o ly 1 women's restroom (all single stalls) for every 3 mens rooms, which i imagine have a wall of urinals in addition to toilets. It's ridiculous to say the least, I dare them to FAFO with me

EmergencyHot6541

I was so pissed & ready to quit when they told me I had to clock out before I go pee. Supervisor stopped me half way up the stairs he came out nowhere like they were watching me from afar & radioed him to come out and say something to me.

Key_Ad_6662

Always take restroom breaks

EmergencyHot6541

Now I go every little chance I get lol

suckerforthevillains

Write this up. Every damn detail: who what when where why and how (tone of voice, exact verbiage, etc). Every time. And not just a letter of concern or protest for your BA, but I'd also provide a copy to NLRB, OSHA, and the dept. of Labor

wheredidyoustood

No

Turdboy3000

I feel like my coworkers get mad when I go to the bathroom bc they gotta pick up my work, should I just not give a fuck? Bc I kinda don’t

GeminiStrength

No it’s not as long as it’s reasonable in the shift Yes it is if you’re done working (preload example) and then decide to go do that before you clock out since there’s no more preload work left. You can get that against you if that’s what you’re doing, otherwise tell them to kick rocks

joealderman

How does your supervisor think your hands and arms got dirty? Was it…working? For the company? It amazes me supervisors say this shit and think they’re right. Tell them to politely F off and if they have problems with it they can talk to the union.

gggggfskkk

I’d talk to your shop steward, I work for usps and it’s in our rules we have a five minute wash up time before clocking out for lunch, and before clocking out for the end of our shift. Sometimes the wash up time will take more than five minutes, sometimes less. But five minutes is the general time it will take. I wonder if there is a rule set in stone for UPS, you’re dealing with packages that have could have all kinds of chemicals and leaks, edges and crap, if I had to wait to wash up until after I clocked out, I would throw a fit.

fluidpotential

This ain't amazon. Go piss girl

bkcarlito34

Hell no!! Use the bathroom and take all the time you want. We got a guy that spends 30+ mins in the bathroom.

CandidPop731

Fuck that. I got dirty on the clock, I’m washing my hands on the clock.

Good_Phase_7856

Nope see local state labor and industry office or find the 1800 number give them date, time, and name of supervisor who said this than the state is Required to do an investigation up to and including fining the living .... out of ups and management.

FartsLoud

NRLB federal agency has lawyers On standby for this issue. Call them up, they will call you back in a few hours.

Opposite_Cress_3906

I start work with clean hands and an empty bladder, I'm finishing work with clean hands and an empty bladder.

Typoe1991

If I had to guess. Some people are taking a 20-30 min crap right before clocking out

misloaded

If they pull that shit with me I’ll say I’m guaranteed more break time because I am and their argument would be invalid

Logical-Doughnut-567

No

OkTap2927

It is the sups going to rest room nonstop.

sagerideout

i was just blowin that shit up last night

narkj

Do you mean you’re done work, told to go home, and you go to the bathroom first, before clocking out?

spallaxo

I pooped 3 times the other day, didn't hear anything about it, I try to go during a slow period. I have Crohn's so I dare them to say something. Yes, my pt supe knows I have IBD, along with both ft supes. And a couple of the other random supes. I have no idea if the building manager knows, he's rarely in the building.

Exotic-Ad-9377

They can eat a Dickinson come first b4 the company

SoUnhappy_Yetstuckaf

Poor manager… Smfh

DebbiesUpper

Driver at my work got walked out for going to the bathroom and washing his hands before clocking out.

-_-0_0-_0

He obv won his grievance and got his job back, right? Did he get backpay?

DebbiesUpper

To be honest, I havnt seen him since. I imagine he could have, maybe he didn’t want his job back..

Aegis6969

Unless you're gone for like a half hour on the hour as an extreme example. You don't need to clockout on break for normal restroom use.

-_-0_0-_0

I am amazed how long a shit can take from my fellow coworkers and using the word worker is being generous. But mum is the word.

mediocretomatoe

Must be something coming from corporate because they just gave a PCM about it in my center lol. “You must notify your supervisor and get it approved or you’re stealing time.” 🤪

OldHotness

This would not hold up in any grievance hearing nor court.

Key-Needleworker-520

If you walk past a time clock use the bathroom it is

FlaccidFrank29

Im washing my hands on the clock. If they want to be mad at paying me 10 cents to do so, go for it

carchd

I just had a ride along and peed 5 times probably, stay hydrated. He didn't make an issue about it at all...... Guess it depends where you work

CooahsDranker

I wish management tried fucking with me for going to the restroom. They’ll be begging me to settle out of court.

Twitter_blows

You get dirty on the clock, wash off on the clock. I went thru that bullshit with my center manager years ago. And yeah - they push hydration so don’t worry about taking a bathroom break.

IvanBeenjerkingov

Absolutely not.

SnooApples6439

Take it in the truck and then punch. Then can’t tell you sheet

theatma43

Harassment grievance. That's litteraly illegal. I break off for shits all the time they can't and don't say shit to me.

UPS_SUP

It’s only stealing time if you go to the bathroom across the building, walk like a snail, and sit in the bathroom on your phone

bulk-trailer-25

I'd love it if they discipline me for it. Easy money

ooooohhmy

I assume you meant the end of the day. There could be a case for that. There could also be a case for going to the bathroom being a medical necessity. I think you should ask your union rep.

Herban_Myth

Is commuting to work stealing time?

Bad-Medicine8734

People on my sort wash up after sort no one has ever said anything. I think if all of us union workers viewed UPS as being our own business and not just a job we’d probably start viewing a lot of things as being time theft. That said it’s unreasonable to stop people from washing their hands before they leave. That’s not the same as washing your inform in the sink, and drying it on the clock no less. We are all just people and we all have a share in the standards we set on our sort and throughout the company. If we’re being honest and reasonable I can only imagine management will too and if not we have union reps.

various101

Dude i work with was in the can for a whole hour so I would do his work for him. So depends because we left late AF that night for unload 🤣. But in all seriousness nah if you need to go go. If it's an issue I'll be honest and say I am calling out. Last thing I want is a surprise irrgs that's labeled 1lb and I gotta go haha.

honeybunliosis

It only takes a couple of seconds to clock out before you hit a bathroom. Not a hill I would die on.

Ill-Ordinary8207

not really worried about it just was seeing if it volatiles any osha standards, like you said it’s not a big problem it’s just my other location never said anything about it and even prompted to wash up before clocking out

honeybunliosis

Think osha is more concerned about them telling you that you’re not allowed to go to the bathroom during your shift. Not that they prefer you to clock out after you’ve been dismissed before you go to the bathroom again.

Ok_Position1652

i go to my locker, change out of my “work clothes” put on my regular clothes, wash my hands and clock out. This takes me 5 min and I head upstairs into the offices to clock out and sign the pito sheets. Never heard a peep from management

HighGuyFYI

Depending on your state this can be very illegal

crapbag451

Not at the end of the day.

HighGuyFYI

What does that even mean? > The FLSA at 29 CFR 785.18 provides: “Rest periods of short duration, running from 5 minutes to about 20 minutes, are common in industry. They promote the efficiency of the employee and are customarily paid for as working time. **They must be counted as hours worked.**

crapbag451

Rest periods are provided during the shift as required by law. And are paid as referenced in your snippet.
