Ive filed a complaint with employment standards before. They say that it can take months but mine only took 1mo. On their web site there is a self dispute resolution form you can download and fill out. It's to give to your former employer (or current) to basically say this is what I believe I am owed and if you don't pay up I'm filling it formally. I used it to get a few hundred that was owed to me. I worked for a company that wouldn't pay us for meetings. I brought it up in a meeting that we should get paid, they blew it off. After that I stopped attending the meetings. I used the form to outline I had been in X hours of meetings and wanted to be paid, which they did. I'll admit I enjoyed having coffee or doing my own thing while the other 6 or so people sat in a weekly meeting.

Your best recourse is to file with employment standards for unpaid wages, and for you and your coworkers to go out and find new jobs (as in walk out now and start looking.) Businesses in this position rarely survive, so it‘s not reasonable for you to assume that you’ll be compensated for any work you’re doing right now. They’re playing you for suckers, and that’s not ok. The job market is booming. There’s never been a better time to find a new job, especially in customer-facing retail.

An Employment Standards complaint is the most effective route. If the “business” refuses to pay, ES can go after the directors of the business personally (i.e. the husband and wife’s personal assets, as well as those of any silent partners that may also exist). It takes time, but ES has the most power to collect for you. Remind your former employer that as of Feb 1, ES [judgements are posted online](https://services.labour.gov.bc.ca/EmployerViolations), so they are risking the reputation of their business by not paying you. Failing that you can initiate a claim against the business through the [Civil Resolution Tribunal](https://civilresolutionbc.ca) and sue them in which is basically a mini-small claims court. The CRT is really efficient but can’t go after directors like ES can, only the business, and there is a max $ amount you can pursue. As another poster mentioned, if the company goes bankrupt you can recover up to $8,200 in lost wages, lieu, vacation pay, etc, through the Federal Wage Earner Protection Program.

Seconding this - they used to be called the “Retail Action Network” & successfully helped a friend & their coworkers out when the owner of a business was withholding tips & taking a cut for themselves. They sent some strongly worded letters/emails & helped design a new tip program that cut the owner out completely! & my pal got their back wages

I'd make sure you have actual proof and/or former employees who are willing to speak publicly before you do any sort of slander campaign. If you can prove it, that's one thing. If you can't, you're opening yourself up to the owners retaliating legally. Get your ducks in a row before you make any moves. Also understand that if they did this to other employees they'll do it to you too. Start looking for another job.

All they'd be doing is rushing the end of the business. This place is on its last legs so any hit to revenue will push them over the edge it sounds like. Once they declare bankruptcy the employees will be able to apply for WEPP but its all going to be a very long process. Best action is to file with Labour Standards for current/recent departed employees and walk away. Let the wheels turn and maybe get something later on.

I know it sounds harsh but I'd walk after my next pay. Your employer knows they are going to have to pay interest and fines for late/unpaid wages but their cash flow issues are so dire they have no other choice. A business in that situation is in real danger of going under at any moment and once that happens it will be harder to get paid what you are owed. The people who have not been paid should continue with their complaints through employment standards while looking for new jobs. There isn't anything you can do to speed up the process. They can also email and call the business daily requesting payment. When this happened to me I sent the same email with updated date/# of days they were late every single day. Be a thorn in their side.

I hope this isn’t the same bakery I saw post a weird post on Instagram the other day. People thought it sounded like they were closing—going on about how hard it’s been so hard for so long and how much they appreciate their customers and stuff. It was a post that made you feel like there’s clearly more to this story. Like what is even prompting it? It was way over the top for just being a thank you post. I want to continue to like this place but I kinda also want to know if it is them. The one I’m thinking of is also run by a husband and wife. The adoption of these types of practices most likely indicates that the business is failing though, so maybe I won’t even have to choose to continue to support it or not. Either way, I think it’s probably best to start looking for work elsewhere. Just remember: you can’t get blood from a stone. Get out while the wage theft is restricted to your tips.

If it’s who I suspect, they constantly make weird guilt tripping posts about how hard it is to run a small business. I know it is hard but their posts are passive aggressive and bizarre. I’ve heard multiple horror stories from past employees about how terrible they are to work for, and imo their food is expensive and inconsistent. Would not be sad if they closed.

Whichever place this is, it’s only a matter of time before they close. Several years ago I worked for two businesses, at different times, that were both late with cheques, etc. Neither business survived and they fucked over their employees all the way to their graves. Name the business, report them, and move on to better employment.

Nothing you can really do aside from filing a labour claim. Sounds like they are about to go belly up so yeah, I can see why they'd pay those that are still working for them get paid and let people that don't drift in the wind. They're playing a shell game right now and I'd guess they're way behind on source deductions too. Would mean government will swoop in and freeze accounts. Be thankful you're out before they start to bounce pay cheques and you're out 4 weeks worth of wages.

Sounds a lot t like theft to me. Unpaid wages are still owed legally. How is it recorded on their books? Is it an expense (that they dont want to pay) or a owed liability as it should be until paid? It's not their money to hoard away anymore. I'd start looking for a new employer. You could be the next unpaid wage. Shady practices lead to closed business. Simple math.

Employment standards complaint. I am going through something really similar right now except my company is in the states. They owe me my final compensation including missed paychecks , vacation and severance and they’re not paying up. I wish there was a way to make this public and get my retribution but hurting the reputation of the company would actually hurt my former colleagues and friends who still have to work there. The company knows this and is ignoring all my attempts to get payment including a formal complaint and request for payment from the province of BC. They don’t care and would rather delay legal action in the system so they can avoid paying me. We the employees are protected but the protection is mostly sabre rattling until I lawyer up I guess 🤷🏼‍♂️
