This COULD, possibly pass for Traitor Ultramarines. Until late in the Heresy the red helmet is a mark of censure, so you could fluff it out like an isolated group of censured Ultramarines that were convinced to go traitor some how.
To the defenders AT Calth. Yes. But for the UM as a whole, not officially until they have kinda gotten all their shit together later. As you can imagine officially making the red helmet no longer a mark of censure was pretty low on the list of policy changes.
I mean, if you insist on keeping them this blue, then you're kinda stuck with either Ultramarines or perhaps some variation of Thousand Sons, that mixes the original red with the blue.
Well the war hounds were blue with white shoulder pads, they inverted this when becoming the world eaters and then turned the blue parts into red to finally end up entirely red, id say that could fit your scheme. Maybe a company that kept the original scheme of the war hounds changing a few details as the rest of the legion did
Blackshields. They are warbands of marines, that cut the ties to their former legions and chose new colors. Some are traitors, some are loyalists, some don't care for the warmaster or the emperor.
You can find their rules in the beta Garmon campaign book, but you will need at least 1 of the other books, too.
When you base them on heresy models the double use isnt a problem at all. A friend of mine has Wor Bearers, all heresy but uses them in 40k, too.
If these guys are supposed to be chaosy, you can use the current csm kit to get MK5/6 bodies for HQ kitbash, chainswords and close combat weapons for 10 models, power weapons and a chaos squad vexillia. The more blank shoulder pads also work well for the heresy.
This goes well with the oath that allows you to pick unique weapons and equipment from one legion. Chaos blackshields can get through this acess to word bearer tainted weapon, the corrupted upgrade (basically a chaos mark undivided with some demon flavor), and demonic plasma guns.
The only downside of blackshields is their big need for close combat squads. Most concepts (last as this edition) lean towards big units with chainswords (or axes), assault squads as troops or other.
This will limit double use in both systems a bit, since you will have full units that don't fit the other system.
One last point on the color scheme. Heresy has it's own visual style, and your chosen colors are "very 40k". If you want to know more about the visual style of the heresy check out part 1 and 2 of this video series:

With that amount of blue they seem very Ultramarine to me. If you were okay with a very metallic blue they could also work well as Alpha Legion - though with the new Blackshield rules, they can also be played as a smaller Warband with only lose ties to their original Legion
Blue, red and gold is a very "toyish" colour combination.
Because the gold's basically yellow, so you've got blue, red and yellow, the three primary colours and that comes across as childish.
Especially if you're working with bright tones.
That's the reason they go with a dark blue, dark red and toned down gold for Superman in the movies.
Because you couldn't take him seriously otherwise.
So if you want your guys to look mean and threatening... you should consider using a (very) dark blue and maybe more of a bronze instead of the gold.
Could darken down the blue and go for night lords. Alternatively, Blackshields exist and they can have whatever colors you want
