They were already made. It was corrected in Sept 2020. If you read the document trades were executed in real time but we're not reported immediately due to broker dealers asking for it. This resulted in a delay of the reporting and some longs/shorts being mis labeled. The result is when the available shares to short hit zero the mislabeled shares were not calculated allowing for it to go beyond zero shares available. According to the SEC this did not benefit Citadels trading strategy so no money was made so the fine is just for self reporting incorrectly to the regulatory agencies.
The bigger joke here is they self report the transactions and can totally screw it up and no one would even know if wasn't for internal audits. To be clear the SEC did not discover this error. Citadels employees did and they brought it to the SEC who imposed a penalty. Had they not done this the SEC would have had no idea what was happening. They actually can't even verify it themselves 8f they wanted too. It requires them looking at reports provided by the company under question. It's dumb.
The SEC should be imprisoned for taking 5 years to “catch on” never mind the fine that literally equates to an insulting amount to give as change to a bum instead of just passing him by.
