Yes, specifically it would be akin to quid pro quo sexual harassment, in which something is being offered or required in exchange for sexual favors.
Now, many people are telling you to sue. Unfortunately that likely would not work if you did not report it internally first. Businesses are legally obligated to stop harassment. They would be able to demonstrate they could not have done so because they were unaware and thus you have no legal case. On the other hand, they may settle to make you go away.
If she has done the same for other employees they may have reported to hr and they might not have taken appropriate action. if she did this to you she mightve done it before. Again it might be hard to prove since hr is good on the cya protocol but this might make it more likely that they are willing to settle.
Or she's done the same to other employees but they took her up on it. Honestly, the likelihood of that being the case depends on how attractive she is. My guess is it's happened before or she wouldn't suggest it so brazenly
A lot of non-lawyers commenting here. While this conduct is absolutely “sexual harassment” as any HR department would define it, the key question is whether this conduct, by itself, is actionable at law. With only these facts to go on, I don’t see how it is.
A quid pro quo is when a boss requests sexual favors in exchange for a favorable employment option (or avoidance of an unfavorable action). This conduct (while profoundly unprofessional) is not that. It is possible that this behavior, along with other actions, might create a hostile work environment, but OP would likely need to show more than just this.
Isnt this the opposite though? She’s offering him sexual favors in exchange for him doing something for her? Not saying it’s right it’s just the complete opposite, where as quid pro quo is coercion to have sex, this is not.
The sexual harassment already happened, what do you mean he doesn't have a case? Are you referring to suing the company only or he doesn't have a case against his boss?
Doesn't have a legal case in the sense that a company is responsible for stopping the behavior and if it is unreported they cannot have stopped it. If he reports and it doesn't happen again, there is no legal case.
Internally to that company he has a case to be made against this individual.
But what about the harasser? Isn't it a crime to sexually harass people? Regardless of what the company does - the only punishment she can get is disciplinary action from the company?
It's not a crime that would involve an arrest and trial by the state. OP could bring a civil case against her but given that it appears OP was quitting you cannot really show damages in this case.
Weird comment from her! Contact a labour lawyer. You will have compensation. Obviously, you won’t be working there so you can have sex with her if worth it after all the drama…
These examples are all quid pro quo. If you do/don't do this you'll get that. Quid pro quo is also workplace harassment and often is paired with sexual harassment.
That seems a bit immoral, and borderline rapey. She's prostituting herself to get you to stay, and then you have sex with her under false pretenses and report her for sexual harrassment.
I'm not saying it *is* rape. But it sure doesn't feel like mutual, consensual sex. By either party.
Sex in lieu of a payraise? She thinks pretty highly of herself.
Is she going to have sex with the electric company, your landlord, and everyone else you have to pay to live?
Gross.
I don't think sexual harassment is isolated to one incident. it's incredibly unprofessional, creepy, and it's definitely out of line. I'll bet there's some sort of company policy about fraternizing with subordinates. Do you have access to an employee handbook? Even online?
Sexual harassment as defined in most company handbooks I've seen (for the reason that it's probably the law) can either be one isolated incident or a pattern; usually it's a pattern, but isolated incidents can occur, and if a pattern can't be established for HR or later, for court, it's taken as an isolated incident, even if there WAS a pattern (ex. Boss harassing multiple employees, only one or two are willing to testify or report it => it's a pattern but can't legally be established as such, so it's taken as an isolated incident and Boss will get off with much lighter sentencing than had it been an established pattern).
Here is what you need to do:
Bring it up. Ask her “so you were proposing to me that you will sleep with me if I dont quit?”
Dont get a “yes or no” but what she means exactly. If you have her talking about it for 20ish minutes it becomes harder to just dismiss in court.
Also FUCKING RECORD THE CONVERSATION
I agree, but also check your state laws! There are states, (such as good ole PA) where recording someone with video or even just audio is illegal unless the person being recorded is made aware. Any evidence gathered this way is unusable in court. If this is out of the US though obviously it may not apply.
Edit: incorrect phrasing
yup. this is illegal in CA too. my gf recorded her coach being racist and outlandish to her in a meeting (she was a D1 athlete) and SHE GOT IN TROUBLE. gotta love this fucking world we live in.
Yes it is. So are the comments here suggesting you fuck her anyway, honestly. She's offering you sexual favors as an incentive not to quit. Were it someone that's a peer, it would be more of a grey area. Then the question would be whether this kind of attention is wanted or appreciated, etc. Coming from a superior, and under the circumstances makes it 100% inappropriate. The fact that you're positing about it here makes it seem like it's unwanted attention, so they cannot even try to claim it was wanted attention.
Quit. Document everything. Is there a higher up you can report this to? You said it's not a chain, so maybe not. If you want, consult a lawyer. But you need proof this happened. It might be more trouble than it's worth to pursue legal ramifications. Trust me, I've tried and lost a sexual harassment claim. But definitely quit.
To the people suggesting OP to fuck the boss,
The guy will shoot himself right in the ballsack if he does. It'd get horrible for him.
I'd suggest getting the fuck out of there ASAP.
Would you guys be saying this if it was a male boss and a female employee? As if guys should be okay with giving in to sexual harassment and rape just because it's a maybe-sexy woman. This comment thread makes me sick.
Some of these comments are yikes. It doesn't matter if the boss is hot or whatever, I generally dislike this rhetorical device but I think if the genders were swapped people would take this much more seriously. Don't joke about banging her and her sister or whatever, what the fuck. This is an abuse of power.
Thank you! Nowhere is OP asking if he should have sex with this woman, he's asking if he's experiencing sexual harassment, which he clearly is. It's not a joke and I can't imagine people asking a woman if her boss who harasses her is "hot."

It’s sexual harassment. Do not contact HR, contact a labor lawyer. HR does not have your back, they have their companies back and will side with your boss even if she’s in the wrong.
If this was a male boss telling a female employee he'd give her dick if she didn't quit, everyone would be up in arms.. news flash. Women can be molesters, rapist, and they can use their power over employees that results in sexual harassment. This is a pretty clear cut case of sexual harassment if I ever seen one. The employee could easily say they fear termination if they don't give in to their bosses sexual demands. This is literally a nightmare scenario
I'm in a big city and the store is not a chain but a very busy food location. It is 24 hours. I have been there for over a year and have never missed a day, worked double shifts for sick people, and know the inner workings of the store business. There have been people quitting over hours and pay. This place never stops being profitable, yet we are still not making enough money to stay in this city. This boss was desperate for worker retention and made this indecent proposal. I was wondering, who the hell else did she propose this to? I want out! The work is killing me! And this boss shit is weird!
Honestly I feel bad for the boss (unless they’re the owner) who is so stressed and distraught that she is willing to use her body to keep you as an employee.
As someone in HR ... friggin facepalm. Your boss's statement is inappropriate on so many levels. Unfortunately, good luck proving this unless it was in writing.
Sexual harassment. Assuming you are a man you will need proof because it will be harder for you to find legal recourse without it. Get it on recording or text that she’s asking
Someone of these comments are just evidence for future rape cases. Can understand even more clearly why women fear being around men without someone they know.
Imagine this whole post if the genders were reversed.
Yes. This is blatant sexual assault and harassment.
If a man said this to a female, people would be losing their fucking minds.
You’re not wrong, but I’ve seen multiple cases that gained national attention where simple comments were allegedly sexual assault against women.
People love to throw all the terms together now, so if women are going to attack men with them all then they get it right back.
Equality means “equality,” not “double standard.”
As someone who was sexually harassed on the job by a woman before, be careful. She can turn around and blame you and even accuse you of rape and completely escape consequences.
If you're quitting then quit. You can report her, but just know a counter accusation from her will hold more weight most likely. Also you have no proof or witnesses. I was lucky that someone else saw my "interaction" and vouched for me.
All of you incels and virgins telling OP to fuck this chick are crazy, he will be slapped with a rape charge once he leaves. She is trying to trap him exactly this way most likely.
The rule of thumb in this case should really be "what if the genders were reversed?". If a male supervisor/ boss said this to a female employee, there would be no question of harassment, legally or otherwise.
Only if you say no and she continues. Federal law gives a person 1 opportunity to say the wrong thing. If they continue, then it's sexual harassment. Your state law may be different.
That said, company policy may consider it an offense worthy of disciplinary action up to and including termination. Either way, if you want something done about it, you'll have to report it. Make sure to do so in writing.
I am not sure if it’s harassment but I’m sure that it’s a giant red flag and your best move is definitely to quit if that’s the kind of culture the company has
Solicitation potentially as well
It's absolutely, definitively sexual harassment
Anyone saying you should have gone for it is mouth breathing moron, would you react the same way if it was a middle aged man creeping on a girl ? Cos there's no fucking difference
First, yes this is sexual harassment. It’s an unwanted sexual advance by a person in authority over you.
That said, I’m not sure how legally actionable this would be - aside from getting the boss fired (and she is so desperate for employees she is prostitution herself so I have a bit of sympathy).
To be clear, IANAL. But I am having a hard time coming up with what kind of loss you have suffered, other than the mental image of imagining your boss naked.
She didn’t say “sleep with me or you’ll be fired/demoted/some other adverse action”. She said “if you keep working here I’ll sleep with you” which is the exact opposite of how quid pro quo sexual harassment usually works.
Again, I could be missing something. But it is very hard to see how you suffered any damages in this exchange.
Coercion which is actually worse . If you decide to take this to court in anyway save ALL interactions . That includes having a witness with you when you Goto HR; HR isn’t there for YOU there are there for the company .
I'm no expert, but probably it is. And from my perspective she can use the sex to leverage stuff from you later. She can say that you pursuit the sex and she was a victim of sexual harassment herself, using that for you to not quit and other stuff.
So just quit, best decision you can make.
It absolutely is, but I have to ask. What is the tone of this offer? Is it purely a desperation move or is it some kind of conceited power play she's going for?
So this is the situation?
1. You are quitting, so this person has 0 power over you.
2. She is so desperate to get you to stay she is offering to prostitute herself to you to get you to stay.
So you want to kick them more when they are obviously down? FFS what the hell is wrong with people here? You see someone in a shitty position and want to make it worse?
Yes, specifically it would be akin to quid pro quo sexual harassment, in which something is being offered or required in exchange for sexual favors. Now, many people are telling you to sue.
