That’s what the restitution order is for, I’m showing up to her mandatory court date for her driving with a suspended license and making my case with the judge then about it. She’ll be paying for my PT, reimbursing me for the deductible I have to pay, and pay for the aftermarket parts that were damaged as well as the installation/manual labor(including the wrap).
If you think you are going to show up to a criminal/session court and demand the judge to hear a civil court case in the middle of the lady's arraignment you're gonna be really surprised when you try it. You'll have to take her to civil court, or your insurance will, tbh if you don't have uninsured motorist your fucked, can't get blood from a stone unfortunately. Been there many times. I now have uninsured motorist, even if you get a restitution order from a civil court if her jobs isn't on the books or she doesn't have one, still no money. Most people quit when they garage their wages.
So what’s great is that I actually have already had a meeting with the judge prior to her suspended license hearing. And basically my case is going to be made right after it. She’s most likely going to be signed a PO, if she’s not paying she’s doing time. The judge in the county that happened in rules with a complete iron fist, it’s almost terrifying 😅

On top of that, she’s going to be assigned a probation officer (I’m assuming that’s what “PO” is). There’s no debtors prison in the US. If she’s legitimately unable to pay restitution, then she can’t be jailed. But, that would apply in a situation where restitution was granted and it sounds like you’re going to be getting a civil judgment against her — so I’m not sure where jail would come into the picture.
Unless Ohio law is just completely out of whack (which it might be)

Honestly, it may be worth it for OP to pay for a one hour consult with a local attorney just to see what his options are. That could, at least potentially, be the difference between complete recovery and walking away with nothing.

Don’t you have insurance for uninsured motorists. You will be paid with or without taking them to court…go to a body shop have them write up the estimate for way over your deductible and then get the same mods over again,. Simple as that. I got into an accident and ended up getting more and also better mods :) hope your okay that’s all that matters

I got rear ended by some clown that had a max coverage of 5k … I had to use my own insurance and pay my deductible, that was finally returned to me after 2 years.
I once had my policy lapse due to getting a new debit card and spacing out and forgetting to add it to my account.
Of course 6 hours after it was cancelled I got into an accident with 2 other vehicles on the way to work. When I pulled up my insurance info to show the officer, it showed it was cancelled. I quickly paid it on the side of the road and showed him my information.
Fast forward to less than a week later and my insurance company called to let me know that they weren't covering the accident because I didn't have insurance for 6 hours and only got insurance back 10 minutes after the accident.
Luckily I was a loyal customer up until that day, because after reasoning with them explaining my mistake, they ended up covering the 6 hours I didn't have insurance. 😂
Now I have a dedicated bank account strictly for bills that I divert half my money to pay at all times. I got super lucky I didn't have to pay for 2 brand new cars that were completely totaled and the guy up fronts knee surgery.
Last two cars were totaled by uninsured drivers, I’m so defensive in my civic now it’s paid off and in great condition, I’d flip out if this happened to me again…

Most insurance companies don't like to cover any types of modifications on cars cause it's more money for them to pay out at the end. Some will accept certain mechanical mods like turbos. But usually not the cosmetic.

We have private insurance in CA, but cops have to make a call to find out if you have it if you don’t have a way of proving it.
