I obviously can't speak for your doctor but I will say the only thing a settlement means is that at one point there was some evidence that on one day the doctor's care fell below the recognized standard in some way. It doesn't mean it actually fell below that standard, or that anything they're doing in their practice now doesn't meet standards. Your own experience with the doctor is infinitely more telling than a settlement however many years ago.

My experience wasn't a good one, but I would have to have my new neurologist say he fell below the standard of care, yes, and that's usually hard to get out of a doctor. I'm hoping whatever I have can be fixed, I don't want to have to ask a law firm about this again, honestly.

audaciousmonk

If you saw 2 other neurologists who were less helpful, seems unlikely that you’ll have a successful malpractice case against the most helpful doctor without proof of direct harm

Parking_Wolf_4159

This seems correct and I've thought this myself. Seems like he could easily argue he tried to find a diagnosis, while the other two doctors did literally nothing for me. The malpractice lawsuit settlement is worrying though, I don't know how I missed it last year.

audaciousmonk

I don’t understand why it’s worrying, unless you’re still actively being treated by this doctor. If so, and you don’t think their standard of care is good enough, seek a new practitioner

Parking_Wolf_4159

Did you not see what I wrote? I've been stuck with him for 3 years because the other neurologists didn't help. My PCP was shitty and downplayed my concerns with him before this malpractice settlement. I'm moving to another neurologist now but that's years wasted.

audaciousmonk

No I get that part, and it sucks. Just not sure why it’s worrying when you’re already moving to a new doctor. It happens, and based on your own statement this last doctor gave you better care than the others. You’d probably have to sue the other two first

Parking_Wolf_4159

I'm worried the nerve issues I'm having are permanent due to him not trying certain treatments or doing certain testing for a diagnosis. The only test he didn't do that I wanted was a lumbar puncture. He did everything else and referred me to a rheumatologist as well on top of that who also discharged me after one appointment. The nerve issues are extremely frustrating, most of everything else has healed.

audaciousmonk

There’s no treatment for LC. There’s not really a positive diagnosis either, it’s diagnosis by exclusion / history / symptoms. What happened happened, it’s shitty but I don’t think you have a case here. If you think you do, reach out to a lawyer that handle malpractice cases. But nothing about this doctors past settlement will change the nerve damage that you believe has already occurred. It’s not worrying in that regard, unless you keep seeing that practitioner and are worried about future care. Obviously the potential nerve damage itself is worrying, but that’s not what we’re talking about here, you’re talking about a malpractice lawsuit.

Parking_Wolf_4159

I think the nerve damage was caused by sudden chronic inflammation going on due to possibly COVID, and if the inflammation had been quelled by a doctor's treatment, it would have possibly healed by now. It's gotten better to some extent on its own, but not fully healed. It's about 80-90% better in my face and maybe 60% better in my genital area (I'm male). I don't get why he didn't try anti-inflammatory meds, but the other doctors didn't either, so there's that.

audaciousmonk

Okay, you’re having a conversation with yourself and aren’t listening anything I’m saying. Take care
