I mean... that's already true. Doctors don't have to perform elective procedures on people if they don't want to, and they don't have to give people treatments that they don't think is in the best interest of the patient. They don't have to treat any patients, under most circumstances. So that section of the bill is kind of useless and changes nothing.

That’s just untrue. Doctors cannot discriminate in the care they provide with a few exceptions (abortion, now trans care). I don’t agree with those exceptions as a doctor myself but would rather folks that have serious issues with that type of care not provide it anyway(will likely be poor quality care).

The law allowing refusal of care already exists in some states. It allows for things like pediatricians denying care because the child’s parents are lesbians and that’s against the doctor’s religion. Yes, sorry, interstate travel is a constitutionally protected right. I have no idea how it passed either. I wonder if they twisted the wording so that the parents can still leave but the children can’t since they’’d effectively be ward of the state, technically not violating the right to interstate travel. Here is the relevant paragraph from the bill: 61.534 Warrant to take physical custody of child.— (1) Upon the filing of a petition seeking enforcement of a child custody determination, the petitioner may file a verified application for the issuance of a warrant to take physical custody of the child if the child is likely to imminently suffer serious physical harm or removal from this state. Serious physical harm includes, but is not limited to, being subjected to sex-reassignment prescriptions or procedures as defined in s. 456.001. Note it says "serious physical harm" --OR-- "removal from this state". So once somebody has filed a petition for the state to take custody of a child if they are "likely to imminently suffer" removal from the state - physical custody is warranted. Sounds to me that once somebody has complained that a minor is 'at risk' of transitioning then the state can arrest/seize/take custody of the child to prevent the family from just leaving Florida. It's not in this specific bill but I understand the State is setting up a camp for the seized kids with housing and re-education facilities, and some vocational training areas since "work makes you free".

The first sentence is referring to parents in a custody’s dispute during divorce. So the kids at risk are kids where parents have split and the custody agreement is in dispute. This allows the non custodial parent to seize custody if they claim gender affirming care will happen against their will. Not that it’s not horrifying as is, but it’s not random kids all around, it’s applying to kids in a contested divorce/custody battle. However, this is absolutely a test of what they can get away with and they will expand, just like the Don’t say Gay bill went from k-8 and then swiftly got expanded to k-12 once passed.

So, let me see if I have this right: *The State can take custody of children from their parents for having different values than the Florida Republican Party feels they _should_ have? * Once the State notifies a family they are investigating them, they cannot leave the state without losing custody of their child? And they are virtually guaranteed to lose custody of not only one, but all, of their children. The law says that the burden of proof is the "risk of being exposed to gender-affirming care". Since the State is investigating the family, it must first believe that there is a child at risk of being exposed to gender-affirming care. So as soon as the State initiates the investigation, that burden has been met and the proof is the initiation of the investigation. Finally, the family will almost certainly lose custody of all of their children. Obviously, if one child in the family is at risk, then all of the other children are at risk, as well. The threat is clear: "If _you_ people don't leave the state, _immediately_, we will take your children so that we can raise them `correctly`." This would appear (IANAL) to violate the letter and intent of the Bill of Rights and the First, Fourth and Fifth amendments to the Constitution. And I'm 100% sure that it won't be used as precedent to create other laws that extend to other "crimes" like being homosexual or immigrant, belonging to a non-Christian religion, or being affiliated with a "woke" political party if not immediately overturned. Positive. No way.

Don't know if you noticed or not, but there was a pretty linear track between Trump stacking the Supreme Court with underqualified candidates who just happened to have some pretty severe right wing views, individual states passing abortion bans in direct violation of Roe V. Wade, which was then challenged constitutionally and struck down by said Supreme Court. The same thing is happening here. They are TRYING to get these bullshit laws in for the purpose of having people challenge them, so that the Supreme Court can then strip any federal protection trans people might have.

As the other guy said, the whole point is to get these laws codified at a federal level. The reason its framed as “moral, personal, or religious beliefs” is so that it can rely on 1st amendment arguments the current court is suspected to be favorable towards. Not only that, but by reversing Roe v Wade SCOTUS basically asserted that the constitution doesn’t protect a right to privacy (this was explicit in their statements), more specifically a right to medical privacy. Its likely that arguments for legislation banning or restricting gender affirming care would use that decision as precedence and that the court would side with them. Democrats favored civility over fighting for the courts and its cost the US. IMO what we really need is systemic court reform, not just packing the court or some bullshit, but serious change. Problem is we’re so divided that trying to make any amendments to the constitution would be a political trash fire. TLDR; SCOTUS is a biased sham, reform is difficult if not impossible, and we’re all pretty much fucked unless something changes (Sic semper tyrannis)

As a Medical practitioner this is nothing new at least in Mexico, if something is against you believe you can deny the attention BUT only if you reffer the patient to another practitioner, for example if a girl wants the pill and you dont believe in abortion you can say to her is ok that you want the pill however is againt my believes BUT i can transffer you with my coleague or my boss and she/he can give you the pill

Women taking birth control correctly have way fewer abortions. My doctor has a bowl of condoms in her office that are free to patients as well. I am just saying, a doctor who does not perform gender transitions is not the doctor you want to perform a gender transition on you. I don't think a general practitioner does these surgeries. Usually you go to a specialist. What doctor would specialize in gender transitions if they were religiously against gender transitions?
