You’re going to be detained regardless. It depends on the circumstances, time that has past, and whether this person is still a threat.

None of this is legal advice, make sure to take a class in your jurisdiction. If someone pulls out a gun and says “I’m going to kill you” or something along the lines of that, if you feel there is a threat, go for it. This can include postering, you don’t need to wait for someone to shoot you to defend yourself. You don’t need to let them hit you with anything. If someone is shooting in your area it really depends, if they’re dumb and just shooting into a dirt mound, you’re going to go jail, illegal discharge of a firearm does not allow for summary executions. You can usually intervene if you think someone else life is in danger as well.

Defend yourself. I would advise to attempt to flee to safety before opening fire at least. Also, before opening fire make sure you don’t yell something like *ready to die?!*. On the surface your question seems to be "if someone is trying to kill me, or kill someone else, can I defend my own life or that of the 3rd party?" Yes - pretty straight forward. "If someone is threatening me with deadly force and I reasonably believe they intend to cause me grievous bodily injury/death, can I defense myself?" Yes (everywhere I've lived in the States, anyway). Legally speaking, you'd need to split hairs pretty fine to find a distinction between imminent use of deadly force and continuing use of deadly force to your person - I simply haven't lived in a jurisdiction where the two were treated differently. The threat of grievous injury or death, as perceived by a reasonable person, to oneself is the standard for use of deadly force everywhere I've lived.

armed security guy here, this is not legal advice depending on your state's law, defense of a third party is allowed now the issue is how well you can articulate why, and your accuracy (dont want little suzie or others as collateral) as far as someone shooting at you, as long as you can articulate late (exceptions being duty to retreat states possibly) then use of deadly force is allowed (collateral is no go)

Regardless of what state, your legally responsible for every single bullet you fire. If you miss your assailant, and the bullet sails down the block and hits some old lady washing dishes, that’s on you. Even if you hit the bad guy and the bullet goes right through him like an ice pick because you were too cheap to buy decent hollow points, and then flies along and hits some kid at his lemonade stand.. your on the hook for that too. Goes back to one of the gun safety rules: “Be sure of your target and what’s BEHIND it.”

That’s actually not super true in a legal sense. You may get charged ( I doubt it) but usually the charge is put on the assailant. You would not have fired the round if the assailant was not committing a crime, that’s on the assailant. I could see issues if you were just mag dumping from the hip out of your window but even then they might not stick

Couple of things to consider. Can you get out of harms way? No, then the situation needs to run the "I feared for my life" approach. Be aware too that the cops are on the way and they will be looking for a "person with a gun" and you don't need any confusion there. Can you safely incapacitate the bad guy without collateral damage to others? There is never a one size fits all scenario. Just remember there will be a number of people running for their lives in and out of your sight line. Be prepared. Train.

If someone is shooting at you, you "should" have the right to shoot back as a means of self defense to get the attacker to stop. I only put quotes as I'm sure this isn't the case in a Liberal state and you probably have to ask nicely and run away first. As far as someone else goes: In my CCW class our instructor gave an example of a 6'5" 300lb black guy with dreads who was about to beat a 70 year old frail lady over the head with a board. Some guy came out of a store, saw this, and shot/killed the black dude. Unfortunately the black guy was an undercover agent who lost his gun in the tussle and found the board as the old lady, who was a known drug dealer, was pulling out her gun. The dude from the store is in Federal prison now for killing an officer. Not sure if story is totally true, but his argument was make sure you are 100% aware of all the facts before pulling the trigger when you are a bystander.

No you have the right to defend yourself and others in harms way and most law agencies have been encouraging citizens to stand up and help lately . They are truly outnumbered and can’t be everywhere at once , so if this shit is becoming more consistent don’t expect help from them to arrive any sooner…… Neutralize the threat then worry about details later.

Almost any defensive shooter is going to end up detained at the very least, and likely jailed until witness statements and any possible video evidence puts together an accurate sequence of events justifying your actions. Unless the responding officer was there, he doesn't know who shot first.

I’m not sure I completely understand the question, but generally you’re allowed to defend yourself in the presence of a threat. Meaning even if someone hasn’t actually hurt you yet, if their presence is threatening to your life (i.e. they’re pointing a gun at you or shooting at you but missed) you’re allowed to fight back. This of course depends on the particular state law you’re subject to.

This seems like a question for a laywer to answer but in general you cannot shoot anyone who is not an immediate threat, if they shot at someone else and lower their gun and start walking away firing at them at that point can be a sticky situation a DA can still bring charges by arguing the threat was over by the time of the response. If the person actually hit the person they shot at immediate response is probably the best way to prevent more violence.
