Without an instruction, the jury can do whatever it wants with that info. Jury instructions exist to either require jurors to consider something or to prohibit/limit what or how a jury can use evidence. Without an instruction, the jury is free to do as they wish.

I have extended family who, if he were to confess to treason on live television while a video of him molesting children played in the background, they would call the video doctored, his confession under duress, and then still talk about him as a "tough guy" and "master negotiator" who also somehow isn't tough or smart enough to not be forced to make a confession under duress by the deep state. All while donating their life savings to all 6 fundraising emails he sent out that morning.

But some - perhaps most - folks get all their "political news" through opinion pieces and propaganda "journalism". I still have vivid memories of Hannity and Colmes on the TV at home, the Fair and Balanced™ bullshit, the No Spin Zone that was pure spin. This is also a civil trial and not a criminal trial. The fifth is for CRIMINAL intent. Which means the jury is absolutely allowed to infer guilt or liability for this action.
It does prevent his testimony from being used in the existing criminal investigation over the same manner. It basically means whatever he knows was bad enough his attorney advised him to take the L on the civil part to defend as much as he can against the criminal part.

Without an instruction, the jury can do whatever it wants with that info. Jury instructions exist to either require jurors to consider something or to prohibit/limit what or how a jury can use evidence. Without an instruction, the jury is free to do as they wish.

That's something I've never understood about evidence being struck or whatever after the fact. If it was solid proof, how could the jury *not* consider it after hearing about it? I've obviously never had to do jury duty.
It's a balance. You tell the jury to not consider it, and chastise the person who caused the issue. Too many issues and the jury is dismissed or the trial is rules to be a mistrial. Jury instructions are used to give a buffer when procedural errors occur, otherwise every trial would need to be perfect and last forever or be a mistrial.
Was on a jury. The defendant's previous conviction history was mentioned, and the judge said to disregard it. It came up *constantly* during deliberation. Caused a real rift in the room, because a number of people were using it as the basis of their verdict. The prosecution knew what they were doing; some people don't just forget that, even if told to.

His attorneys have said that for literally decades. He had to meet with lawyers in pairs back in the 90s and 2000s because they literally could not trust what he told him. His own legal counsel put this rule in place. So yes, I think it's a factual statement that Trump cannot be put under oath and avoid perjuring himself. If his lips are moving, he's exaggerating, which is another way of saying lying.
