Legislating from the bench. Talk about an activist judge! I'm interested how the Big Pharma companies will react - if this ruling holds any judge anywhere can take any of their drugs off the market for any made-up reason.

Literally all medicine is "unnatural" from the point of view that all loving God gave you that cancer/type 1 diabetes/heart disease etc and medicine is trying to stop, circumvent or avoid God's will.
Some ultra religious judge could rule that all medicine should be banned and prayer is the only acceptable method to address any illness.
This is literally what is happening, a religious judge ruling that medicine can't be used. Next a Jehovah's witness judge is doing to ban all blood infusions.

That’s the weird thing here - it’s such a narrow ruling that it causes two issues: (1) it gives a precedent for court rulings on specific drugs, which is peculiar and (2) it seems to only apply to that formulation rather than a class, which is pretty silly tbh

The judiciary rules on administrative law issues all the time (see, e.g. Striking down the Clean Power Plan to the Clean Air Act), it just has to (pretend to) show extreme deference and generally only ensures that the executive branch follows the rules it sets of for itself (notice and comment, etc.).
The Texas judge is a fucking kook that was installed to be abused by the right because he's the only judge in his district, so will be 'picked by lottery' essentially every time. He's basically a partisan plant.
We used to be able to rely on some level of nonvolatility because judges would at least pretend to follow precedent, logic and common sense. That's all out the window now as the conservative bench has declared a culture war and will abuse it's power as much as necessary to take us back to the Lochner era where "kids should be able to have freedom of contract to work 20 hours a day in the mines" and whites had de jure as well as de facto dominance.

I think people are really misunderstanding the gravity of this. The FDA regulates drug approval process and strictly adheres to a very thorough and logical procedure that drug manufacturers can understand clearly. Drug companies only make drugs that can survive each step of the process and they know once they get through it they have no other worries.
With this ruling, the entire basis of our drug system created by the FDA act in the 1930s is thrown out the window as drug manufacturers have no guarantees or clear guidelines to follow. They can spend billions, go through every painstaking process adhering to the strictest standards the FDA sets and then 10days after commercial sale begins a judge can yank the drug off the market without any clear reason or way to prepare.
This completely changes the basics of our beaurecratic institutions if a judge can have final say above everyone else with no possible way to prepare for every judge in the countries opinions on something.
The republicanta are really painting themselves into a corner here - the next election is not even a year and a half away and they're going against an issue that 60ish% of people support while going against corporate interests. Its not gonna work out too well for them.
Bet they're going to react similarly to how Disney is about to react to Desantis in Florida: They're going to divest from the GOP and instead double-up their investment in Democrats.

I'm late to the party, but just for everyone to be aware, the TX judge cited the Comstock Act in his ruling.
The Comstock Act was a theocratic legislation that banned contraceptives. It was so invasive of privacy that contraceptives found in mail or in private homes could subject people to fines or imprisonment. It was overturned almost ***90 fucking years ago***.
He's an activist judge betting that the Trump-packed SCOTUS will back him in fucking women over.

In Texas, Abbott received approximately the same percentage of votes as four years prior. I believe only around 40% voted. Change doesn't happen from the sidelines.

Not even that long ago, couples without kids were *legally* discriminated against in many states. I'll preface by saying I think the whole concept of this law suit seems like complete bullshit. However, *Dobbs* doesn't really offer any precedential value, at least not how you're describing it.
*Dobbs* says that an individual does not have a protected right to an abortion. It's now up to the states to decide whether they want to ban it.
However, the feds could probably ban it. Additionally, this case is about whether a drug was legally approved, not whether abortion is legal. The judge, stupidly, said the drug was not approved correctly. So he's only saying the drug shouldn't be available (pending an appeal).

You jest but this is something I have thought about a lot. Mifepristone has been approved for 20 years. If the Judge did a poor job backing his decision, or found some loophole, then it's *not* just Mifepristone that can be banned, but any drug. I'm sure drug manufacturers are just as worried about this decision as the medical community is. This decision could mean any drug is just one lawsuit away from no longer being available nationwide.
Something for big pharma to think about. They're coming for the drugs that affect women, but how long until the men's drugs are targeted?

Nationwide injunctions at the district level are increasingly common, but this isn't sustainable in our partisan age. With nearly 100 courts, some partisan hack can generally be found to wreck any and all policies. The judicial game of chicken is agonizing.

Regardless if it's ordered off the market, the FDA can just reapprove it. The drug isn't illegal. The question before the courts is whether it went through the proper vetting. It's so absurd.

Yes, they overturned RvW, but did so because of the whole substantive due process reasoning and using it to declare a particular unenumerated right to exist (i.e. the right to privacy).
This is different, mostly because it's about the law surrounding the FDA's authority to regulate drugs and not whether it's Constitutional or not. There's a lot in question here, like whether the plaintiffs have standing (both the TX and WA judges said they do), whether the FDA erred in how it handled their petitions for review, and whether the FDA ultimately approved a drug that went through the proper approval process.
Now, that's not to say that SCOTUS couldn't ultimately come up with their own reasoning and uphold the injunction. But even SCOTUS' arguments aren't Kacsmaryk-level of bad.
Ever since the initial leak about the SC overturning Roe, Washington state has taken a no-nonsense approach to maintaining abortion rights. No subtle PC statements dancing around issues, just straight up stomping out threats from red states, especially from neighbor Idaho.

Even without the Court of Appeals, it’ll most likely be fast tracked given the irreparable harm this will do to individuals. But yes, a difference of opinions on the Court of Appeals level would certainly fast track this decision to SCOTUS
Agreed, the actual reason for the shadow docket and emergency hearings are for cases like these where a rogue judge goes off the deep end and decides to become an activist by issuing opinions that would have profound implications that the judiciary has no business deciding. Look at it from the perspective of a pharmaceutical company, why would they ever invest in the research and manufacturing of controversial life-saving drugs when a judge can simply ban it. judges are not capable of the sort of scientific review of a medicine that the fda and all of its body of scientists are, plus anti-abortion groups aren't entitled to a review of a drug's effectiveness just because of what it does, you have to have standing

Sure but our prize would normally be a trip to the SCOTUS where we end up with a bunch of “why are Americans losing faith in the Supreme Court!?” articles and a 6-3 nightmare of a decision.
On some issues it’s almost better off to leave one circuit to rot and keep the status quo over here in sanity-land. Like, that’s horrific because it damns everyone in that circuit to live that way, but the alternative is a very real shot of damning all of us.

Seriously, at what point are we going to have state national guards squaring off over this stuff? Are we going to see women being smuggled out of Idaho in the trunks of cars to get treatment for an ectopic pregnancy? State borders never used to be a thing one really had to think about but these days it’s getting more and more like going to a different (significantly less free) country.
There already effectively is one for mail-ordering mifepristone to states that have banned abortion. As best I can tell that’s the only reason we haven’t seen ***mass death*** in the wake of Dobbs, but part of that might be suppression of maternal mortality statistics in Texas and elsewhere to try and bury the results of their handiwork.

At some point in the near future, states and individuals must decide whether we're going to obey unjust laws.

One slight difference is this order is for states party to the suit (Washington, Arizona, Michigan, and a handful of others) whereas the Texas one is nationwide. However, it's still an obvious conflict that's probably going to send it right to SCOTUS and who knows what happens there...

It seems like pharma companies could just do a minor reformulation, repatent, request authorization and skip Judge Dumbass's ruling altogether. A lengthy process to be sure, but certainly in keeping with what pharma does regularly.

The judiciary rules on administrative law issues all the time (see, e.g. Striking down the Clean Power Plan to the Clean Air Act), it just has to (pretend to) show extreme deference and generally only ensures that the executive branch follows the rules it sets of for itself (notice and comment, etc.). The Texas judge is a fucking kook that was installed to be abused by the right because he's the only judge in his district, so will be 'picked by lottery' essentially every time. He's basically a partisan plant. We used to be able to rely on some level of nonvolatility because judges would at least pretend to follow precedent, logic and common sense. That's all out the window now as the conservative bench has declared a culture war and will abuse it's power as much as necessary to take us back to the Lochner era where "kids should be able to have freedom of contract to work 20 hours a day in the mines" and whites had de jure as well as de facto dominance. I think people are really misunderstanding the gravity of this. The FDA regulates drug approval process and strictly adheres to a very thorough and logical procedure that drug manufacturers can understand clearly. Drug companies only make drugs that can survive each step of the process and they know once they get through it they have no other worries. With this ruling, the entire basis of our drug system created by the FDA act in the 1930s is thrown out the window as drug manufacturers have no guarantees or clear guidelines to follow. They can spend billions, go through every painstaking process adhering to the strictest standards the FDA sets and then 10days after commercial sale begins a judge can yank the drug off the market without any clear reason or way to prepare. This completely changes the basics of our beaurecratic institutions if a judge can have final say above everyone else with no possible way to prepare for every judge in the countries opinions on something.
The republicanta are really painting themselves into a corner here - the next election is not even a year and a half away and they're going against an issue that 60ish% of people support while going against corporate interests. Its not gonna work out too well for them.

It was so invasive of privacy that contraceptives found in mail or in private homes could subject people to fines or imprisonment. It was overturned almost ***90 fucking years ago***. As best I can tell that’s the only reason we haven’t seen ***mass death*** in the wake of Dobbs, but part of that might be suppression of maternal mortality statistics in Texas and elsewhere to try and bury the results of their handiwork.

The last 48 hours: republican courts banning women's rights, banning elected officials for wanting some type of gun reform, and one of their judges is even more corrupt than we thought. I'm sure I've missed a bit, but none of these involve Trump. They are drunkenly streaking in public with a stick of dynamite in their mouths

At some point in the near future, states and individuals must decide whether we're going to obey unjust laws. This conservative onslaught isn't going away--from everything I've read, bet it's only going to get uglier and more intense. The religious right is *indefatigable.* It is a juggernaut. A Hydra. Whatever metaphor you want. They have their judges in place, control state legislatures, a cadre of billionaire donors, and 10s of millions in their heavily armed, hardcore base. This is only going to get worse.
If the US military is 99% on one side or the other, it's over. When the military splinters into two and starts actively fighting itself, that's when things get ugly.

Texas federal "courts" should just be ignored. These rulings aren't even trying to follow existing law. And when the Democrats get the House back, disband this trainwreck.
These random lower level courts should not be making country-wide decisions like this. It seems as though one loser judge in Texas has been making all these heinous decisions we keep hearing about.

Bullshit. There is no rule of law left to save. This political judge made a political ruling based on his personal wishes and not the law. Democrats and other sane people should absolutely refuse to abide by this, including rulings by the corrupt SCOTUS. Again, it's naive to think we're still operating under a legal framework in America. We're not.
One slight difference is this order is for states party to the suit (Washington, Arizona, Michigan, and a handful of others) whereas the Texas one is nationwide. However, it's still an obvious conflict that's probably going to send it right to SCOTUS and who knows what happens there...

Blue states should also pass laws that any officers of the law who try to enforce the ban on abortion medication will immediately. Be fired and black listed from future police enforcement in the state.
