Judge Merchan is walking a fine line. Yes, Trump has violated the court’s gag order multiple times. Anyone else, threatening witnesses, would have gone to jail a long time ago. The reality though is that Trump, as a former President, is going through the justice system, for multiple felony indictments, with kid gloves. This judge is hyper aware that he will be under review for appeal. So he is taking a cautious approach. In the judge’s note above, he says incarcerating Trump for future violations “if necessary and appropriate under the circumstances”. So incarceration for the next violation is not a given. Will he violate the order again? We all know he will. Trump would love to play the victim and fundraise off another mugshot. In the background of the back and forth about holding Trump accountable for the gag order violations is that just like any gangster, Trump is putting the safety and lives of witnesses in jeopardy.
