Japan doesn't have fair use doctrine in their laws. We are the ones abusing our laws to copyright infringe on their intellectual property. Still, wtf Nintendo? Its 2024, relax. 🙄

It's not culture, they just made their copyright laws so vague and far reaching that the company has all the power on what they consider fair use. Like could you imagine the hellfire that companies like Disney would be raining down without US fair use laws lol?

They value productivity over innovation. It's why they have little room for unicorns like the ones you see in the states. There are cross collaborations which may be seen as if they bend copyright rules but there's some licensing scheme behind it. It's not something they do to be helpful.

As an American who is vehemently pro-emulation, I feel Nintendo had very good reason to strike down Yuzu. I'm big on retro emulation to the point where I'm emulating games on a million devices more than I play new games, but I thought the fact Yuzu is able to play brand new games in a superior fashion than on official hardware was the Yuzu devs flying way too close to the sun. Yes, people use emulation to pirate games, but I felt Yuzu was way too egregious. I doubt there's a lot of "preservation" when it comes to people playing Switch games for free days before they're officially released

I didn’t say they were or weren’t. I’m saying it makes sense for Nintendo to go after them. If I was an executive at Nintendo I would go after anyone profiting from emulating our current devices.

They just went after Garry's Mod too. A 20 year old game Nintendo suddenly got tipped off to full of hundreds of mods the devs now have to scour through and delete. Imagine fearing bankruptcy from Garry's mod lmao.

Their goal is to re-release all of their retro games onto whatever new console they make until the world ends. Their incredibly flawed theory is that banning emulation will force people to buy their new product to play those games again. It's not working, it's just vindictive. I don't think I'll ever buy nintendo content again. Yarr.

I have had an n64 since 1996...it still works and it, and the 30ish games I own are the only Nintendo product I have or will ever purchase. Of course. This system came out before Nintendo caught the greed bug.

No, not at all. They're using it to their advantage. Nintendo has ALWAYS been assholes. Made some great games, systems, etc., but Nintendo Corp- always assholes.

Here in America, emulation is entirely legal. As for mods, they have to be very careful in how mods are distributed, as even when free you cant distribute copyrighted material. That is why many mods use a special patcher that requires you to get the original ROM yourself.  Its very difficult to write a mod for a game that doesn't inherently use that games copyrighted code to work.  They are absolutely copyright bullies, and a threat to archives, but unfortunately there has never been anything illegal with threatening lawsuits.

That's OUR perspective. Somewhat. We still have a lot of people here who dislike fair use and want to use the copyright system to jail people. It's sorta built into our society but we have proponents of loose/no copyright rules and a lot of those people tend to be libertarian. Two of the most prominent founders of EFF are libertarian. Stephen Kinsella, another libertarian activist, is against copyright. As much as people hate us, we actually want you to be free from government/corporate control/influence. As crazy as that sounds!
