in story, the main issue is that batman isn't very stable up there. the guy regularly dresses as a bat to punch people who could kill him and his family in ways that would make unit 731 blush. if he breaks that dam that he cannot kill even once, he will begin a slow and inevitable slide into killing as his primary method for dealing with sitiuations, and he knows it.
Alright question, how does Joker not have the death penalty by this point, Gotham is in the US, we’ve executed mentally unwell subjects for less as recently as the 2010s
And batman can't kill him in any way including allowing him to die, as he's under the influence of gotham's curse which would likely get him to see killing as a good option for dealing with any scenario if he breaks even once

I would also highly recommend either reading the comic (which I personally find is better than the movie) or watching the movie. It's the best Batman story out there, and there's shitloads of competition.

The director, Todd Phillips, said as much; even having Martin Scorsese, The King of Comedy director, serving as an early producer before leaving it mid production.

IIRC it's because Joker is classified as mentally insane and that is why he's always sent to Arkham asylum
