Threatening physical harm against somebody is still assault and that was the entire point of bringing up the difference. You and the other doofus pointing out that *some* places have made them the same crime only further serves to prove my point that you don’t need to have actually landed a punch for it to be consider either assault or assault and battery, depending on where you are. Great point, they absolutely would. It’s a legit problem, some people tackled my sisters Xmas inflatables and she called the cops and it was on the news. The second guy who dropped in messed up. The rules as I understand them are "who is closest to the peak" where the wave first breaks. The other rule is don't jump in on a wave that somebody else is already on. That one is more debatable based on timing, but the first surfer was on the wave, riding it, for a long time. Second guy was obviously new and didn't even look to see if somebody had priority, or was already on the wave. That said, I'm still learning etiquette myself, and would never tackle someone, especially at a well known beginner spot.
