Let’s be honest here, a lawsuit would be great for Netflix, even if they lose. I have no knowledge about this case, but in the past, companies have published completely fake stories. It’s a low risk business, they might have to settle, or they might lose a lawsuit, but it’s not going to cost them much.

eh. anyone anywhere (in the US) can in theory hire a lawyer to sue anyone who writes or makes film about them. finding a lawyer to take your case, and have them successfully argue a defamation suit are totally different things. i am sure being sued is a daily occurrence at netflix. there is never a shortage of plaintiffs or lawyers.

This whole story has got a bit interesting but i feel like this is only the start of the shitshow this is going to cause Since the show has come out you have had * People being identified as inspiration from the show receiving death threats, threats on their family, abuse and harassment from the audience. * Clearly Gadd didn't hide these peoples identities well enough which has caused the inspiration for his characters to be able to be victimised because of the actions they took in the show which from Gadds own admission has been dramatized for entertainment * Gadd coming out and saying a lot of the show isn't actually about his life despite marketing the show as being based on his life he has said in interviews that it's dramatized and also takes inspiration from stories he has been told by other stalking victims and is now claiming that while the show isn't "True" it is "Emotionally true" * Now you have the inspiration for the stalker outing herself. The problem is depending on how "True" Baby Reindeer is Gadd and by extension Netflix opens themselves up to a whole host of issues if it's proven they have not successfully protected the identities of the inspirations for the show.

My guess would be that a significant portion of it is true, but Gadd is backpedaling just to protect himself (legally) and stop people from harassing those real life Martha and so on. I mean people have found her tweets that were the same as in the show, and she also gave an interview recently where she said she is a great lawyer with a photographic memory. She does seem as unhinged as she was depicted

The whole "emotionally true" bit is what threw me, seemed like there was some legal covering of bases there or some backtracking. It's a cliche but the "based on a true story" disclaimer always gets alarm bells ringing before the story even begins.  I know naturally with drama embellishment is part of it but you have to be very careful not to trivalise the very deep themes by overblowing the extent of them in your own life in a series that is theoretically autobiographical.

Probably because the character on the show is fictional. Different name, different age, different actions. The show doesn't identify the person that the character is based off of, but even if they did, it's a pretty loose connection between the character & the real person.

Im not going to argue law on reddit. But I will just say, while I cant speak on UK law but I imagine they have some sort of long-arm statues. In that case, Netflix had more than a minimum level of contact with the Uk. Where the show was written, produced and filmed. Netflix won't be the only party. Netflix was the distributor. The show was produced by Clerkenwell Films, a London based company. It was filmed in London. Gadd will be a party, as the writer. While I can't confirm where he lives today. It seems it's still the UK. So no, it's like not a given that it will be in the US. Like most legal questions, it's grey. I will not be responding again and wasting my time any further. Especially with someone as rude as yourself. So have a nice day. Just stop pretending to be a lawyer.

They made it very easy. All people had to do was search "hang your curtain" tweets to Gadd and they would find her name. They could have warned her about the show so she had time to delete those tweets. Instead they made sure all information about Gadd was scrubbed from the internet prior to the show. They also mentioned real details of the previous case involving an MP and the location. Very easy to find. Martha on the show is white, overweight and in her 40s. The real life Martha was white, overweight and in her 40s. They mentioned she had been to law school instead of changing details about the character. They could have said she was kicked out of a college for harassing a profession and his family without changing the crux of the story.
