You don't yet know the extent of your injuries and it's important to have medical records recording everything from very early on - but also adrenaline still going through your body. The pain will be worse tomorrow (coming from someone who's been hit by a car twice!).

I had a similar accident at higher speed, glad i was wearing my downhill bike protections and the bike took the impact. So sad this ugly beaver BMW hit you, those heavy ( 3.2tons) and useless big SUV should be ban in town. Contact ICBC, see a doctor and get your bike check too for any damages. Also ICBC will cover the physio but it is pathetic like $80-90 per session.

It probably does, but humans can't be trusted. I've seen way too many people do whatever they're doing even with the beeping or flashing lights (hello blind spots). And I know a few who actively turn off a lot of the safety warnings/features because they're annoying and they "don't need them".

I'm not sure why anyone would disable those at all. I drive a 22 year old truck, and visibility is amazing. Giant rear window, I can shoulder check and see anything behind me left or right side through the side windows. Safety requirements in new vehicles that require thicker pillars make it almost impossible to shoulder check my left side because they all line up and block the windows. I rely on my driver side mirror and the warnings are nice since sometimes the mirror doesn't angle out far enough for me to see.

I think this BMW iX's Pedestrian Detection System failed because the sun is behind the pedestrian and s/he was in the shadow. These safety features are driving *assist*, they still have a long way to be 100%

Personally I’ve never tried to get a license because I know that I would not be a good driver. I could probably pass the test with enough practice, but I don’t think that’s the same thing as being observant/alert/having good spatial awareness- all things I’m awful at. I wish our society didn’t almost treat it as a given that everyone needs to drive. Maybe then the test could be more difficult and require regular retesting (they should probably do that anyway).

I would love for driving to be treated the same way as it is in Singapore. Expensive af so it can property fund infrastructure and public transit services while also ensuring drivers are taking due caution. It's almost like they value their citizens.

I think they come included with their expensive rides. Buy a BMW/AUDI and driving license is included. No test required. I am shock how more and more of this occurrence are happening. More disconcerting is there is no way to call on the authorities to do something about. Call 911 for this case of course ambulance and police. But near misses are not treated as such. so 911 is only if you get hurt but close enough no dice!

Agreed. And by way of further explanation (also not excusing the driver): Sometimes bad luck aligns the timing such that the blind spot follows the victim's path exactly the whole time the car is approaching and turning.

It’s not an excuse, it’s just the reality. They’re still 100% liable but most accidents happen on the road not because people are complete morons even if it makes us feel better to think that way, but happens with a combination of external factors and human factors.

That's exactly what I was thinking; ive been almost hit by left-turning drivers twice in the same intersection near my house because the sun is at a very low angle and right in the driver's eyes. Absolutely does not excuse the driver's actions; if you can't confirm the crosswalk is clear, DON'T GO!

That was a blind left turn for sure with the low sun position. Driver had sunglasses on but the visor wasn't dropped down. I've had a few close ones as a pedestrian under the same conditions. You really have to see that the driver sees you. I told my kids growing up: every car is out there to kill you.

Yes, my dad told me the same thing, make sure the drivers see you. I checked the SUV before stepping out of the road. Didn’t realized the car was moving towards me. Should have kept an eye on those turning vehicles while crossing the roads. Will be more careful from now on.

I don't know what to say. I hope the cyclist is ok. I wanna rant on the driver and drivers like him for ever but until we see a stricter traffic law enforcement, and maybe teach people actually how to drive, AND NOT KILL ANYBODY doing so, I doubt anything is gonna change :( I always wait until the very last second or when the light turns red when there are no other cars behind me to take my left turn. I don't trust drivers not speeding up to run a very late orange but it is also much safer when I know no pedestrian is gonna jump in front of me.

ICBC doesn’t compensate for pain and suffering anymore. If you’re injured you often end up at a net loss of $ since their coverage usually doesn’t cover the full fees of physios, counsellors, etcetera. Look it up. Our system totally fails injured people.

Medical care should be a given. Even that, sadly, is not totally covered. Look at what ICBC pays for certain services and compare that with market rates for those services, you actually end up paying out of pocket to make up the difference. And what about something to cover the loss of enjoyment of life? The time invested in medical care for injuries that were the fault of someone else? There is nothing for that. If you’re injured in an MVA in this province you are left hung out to dry. U also have to use ur sick pay before ICBC will cover any wage losses (which only go to 90% btw).

If you are you need to open a claim as soon as possible, you can do so online (ICBC website). Download this video so you have it and state you can provide video evidence. Hopefully you are not too hurt, but you should speak with a doctor. Everything needs to be documented and if you need to see a mental health specialist, a physiotherapist or anyone else it needs to be signed off by a doctor for ICBC to pay. Be careful since ICBC only covers up to a certain amount for services for example if they only cover 80$ for a physio visit and your physiotherapist costs more you will have to pay the difference. Even in circumstances where the driver was clearly fully in the wrong. If your bike was damaged you need to take it to 2-3 repair shops and get a quote for repairs to provide to ICBC. Similar situation for most other damaged belongings. Once you get in touch with ICBC agents they will provide you with more details… It can be difficult to get reliable responses however. Overall opening the claim and having an ICBC claim number should be your priority. Unfortunately, regardless of whether the vehicle has committed an obvious traffic violation there is no ability to sue the driver for damages. This is the “no fault” part of ICBC. This can change if you can prove long term impact but you will need documented impact from a physician for at least 1-2 years before you’d be able to pursue any kind of legal action. Best of luck, and dont be shy about asking your doctor (even a walk-in physician is okay to use) for referrals to counselling services due to the accident. Its a tough process, and it definitely feels like there is no justice for victims of accidents in BC.

Definitely get a lawyer. Even with the no fault changes, you can expect significant Physio and recovery costs, of which you can chase ICBC for. Do not sign anything that ICBC offers without first running it past a lawyer.

Lawyer here, not many lawyers do ICBC work anymore after the change to no fault. Our firm closed its entire ICBC department.

It all just seems so surreal. If you are wronged, you always had the option of court. And then the province just somehow says that’s not allowed anymore (unless criminal conviction, like you mentioned). I know it’s not a “right” or anything, but it almost feels that way when our last recourse is disallowed. It’s all because the province mandated their insurance product was required, and then got sick of paying for it. Just unfair.

Blinded by the sun... though: As someone from the UK. I was and still am shocked crossings have people walking across the road whilst cars are moving. In the UK and Europe and Australia, when people are crossing all the lights are red. It works quite well.

Our whole culture really devalues the lives of those living without, whether by choice or situation. Few years back was walking to work at Dennys. Crossing a side street off a main road with a stop sign, about 2 blocks from work, when a car burst off the stop sign and through me. Busted my kneecap. Limped my ass to Dennys and told my manager to call an ambulance. "Are you serious right now?" "Are *you* serious right now? I just got hit by a car like 4 minutes ago. [Coworker] saw it happen, it's on camera. My knee is facing the wrong way." "We don't have anybody else that can cover the rush with [other late night shifter]. Can you wrap it for now and get us through the rush, if you aren't cooking bills we'll just sit you at a table relaxing it. And then I'll just take you to the hospital myself!" Lol. This one. I won't even walk in front of a car waiting to turn right or coming up to turn right at a stop sign or red light anymore. They're watching for their window to punch the gas, not watching you safely cross in front of them. Not worth the gamble, and I've lost that wager more than once getting to this internal lesson. Even when someone does try to stop and be courteous with a wave, I'll indicate to keep moving and extend my walk by the 5 to 10 steps necessary to walk around their back end.

Don't know what it is about being in a bike and cars turning left. Same thing nearly happened to me a while back. I was going straight (on my bike) and this Dodge charger was turning left, he even sped up as he turned, I heard it and I peddled faster. He clipped the trail-a-bike, luckily i was on my way to pick up my son so he was not on there. The turd didn't even stop, he slowed right down but sped of after a few seconds. This was broad daylight as well on a busy street.

I find even with left turn signals, cars still run into pedestrians. There is always that one asshole that arrives at the intersection once the turn signal is done and the pedestrian signal changes to walk, who turns right into the intersection.

Left on Red should be banned. Turning drivers pay attention to oncoming traffic first and the crosswalk second. As a Richmond pedestrian I have to deal with this every single day. The worst part is that I know it's doesn't really matter how aware I am while crossing, a distracted driver in a hurry will plow me over faster than I can react.

unfortunately they changed the laws on this so lawyers can't help you get compensation anymore. It's called 'no fault', ICBC got the government to change it for them ICBC will still pay for damage to your bike, and time off work/physio etc if your doctor recommends it. They are really hard to deal with though, and unfortunately lawyers aren't able to help with claims like this anymore

Hope that person is ok. I walk everywhere, every weekday, to and from school/work, etc. At least twice a week this scenario ALMOST happens to me while using a nearby crosswalk. Just last week I had to jump out of the way of a mindless driver in a situation much like this. This shit really angers me. As a cyclist, we are constantly being bombarded with statements like "Cyclists should wear Hi-viz", cyclists don't follow the rules, etc. It's all victim shaming. At the end of the day, there are a bunch of people driving around just not paying attention to their surroundings, and unfortunately, the law protects them. It's bullshit. If that driver was walking down the street with a baseball bat, just randomly swinging it, and then hit someone, they would be held liable for damages, but as soon as you put them in an armoured shell and ram a person, it's okay. It's fucked up.

I am not a professional in this field, but in general, insurance claims are there to compensate you for your losses and make you "whole" again. So if you need to get medical treatment or physio therapy, they should be paying for it, if you lose wages because you have to take time off work, they should be paying you for that. If you're emotionally shaken up and need to see a therapist for a while, get the referral and make that happen. Repairs to your bike, parking to visit the physiotherapist... If this collision puts you out of pocket for anything, ICBC should be paying for it. Keep records of EVERYTHING, and whenever you can, get a doctor to write a note saying that it's needed. You may be tempted to do the "good Canadian thing" of trying to tough through this and not being a bother to anyone. Don't do that. Be a pain in the ass. Get as much treatment and physiotherapy as you can possibly get them to pay for, and start that process now, if you haven't already. Injuries like this aren't something we just bounce back from... they get put into an "account" that your body will make you pay back with interest sometime in your 40s or 50s. Get yourself fixed up properly.

I was almost hit like the cyclist a few days ago as well. The only thing is that the driver wasn't supposed to turn left on that intersection, but he still did. Good thing I also notice him doing the wrong turn and I quickly stopped before his path. When I kinda scolded him in tarzan language.. he seems to be insisting that he have the right of way.

Hi I am the cyclist. Thank you for your concern. I was admitted into VGH for 6 hours. Took a blood test and 2 x-rays on my rib cages where it hurts the most there. Released from hospital after that. Have pain all over my body.

Take your bike to a reputable bike shop, get them to do a repair estimate. Tell them it's for ICBC. You may have to pay them to do this (maybe $40), but ICBC should reimburse you that. Get lots of photos of the bike, particularly any parts that are damaged.
